"First Party" is the owner of Lots 2 and 3, King's Crossing Subdivision in the City of Grand <br />n Island, Hall County, Nebraska ("Lot 2" and "Lot 3" respectively). <br />B. "Second Party" is the owner of Lot 1, King's Crossing Subdivision in the City of Grand <br />Island, Hall County, Nebraska (the "Lot 1"). <br />C. "First Party" and "Second Party", by this instrument, intend to establish a maintenance and <br />improvement agreement with respect to "Lot 3". <br />NOW THEREFORE, the Parties mutually acknowledge that the Developer has created or <br />will create at its sole and exclusive cost a detention pond on "Lot 3", in accordance with an <br />Agreement To Complete Detention Pond to be executed contemporaneously herewith. The Parties <br />agree to improve, maintain and repair "Lot 3", subject to the conditions set forth herein. The duty <br />to Maintain, as defined below, shall be deemed to run with the land and shall be a burden and a <br />benefit to the parties and the costs and levies due hereunder shall be liens against the real property <br />of each.
