201907945 <br />Amendment to the Agreement for Restrictive Covenants, Restriction, and Conditions for Prairie Creek <br />Meadows Subdivision, Hall County, Nebraska <br />November 8, 2019 <br />WHEREAS, lot owners signing this form represent at least 2/3 ownership of the lots Prairie Creek <br />Meadows Subdivision, Hall County Nebraska. <br />WHEREAS, Section 21 of the Agreement for Restrictive Covenants, Restriction, and Conditions for Prairie <br />Creek Meadows Subdivision, Hall County, Nebraska allows for modification of the restrictive covenants. <br />WHEREAS, Section 4 states, "Any building constructed upon any Lot located within the Subdivision shall <br />be completed within one (1) year from and after the commencement of construction. In the event a <br />building permit for a single family residence has not been issued by the appropriate governmental <br />authority and construction has not commenced on a Lot within two (2) years from the date title to such <br />Lot is transferred by DMBG or its successors or assigns, shall have the option to repurchase said Lot for <br />the amount paid to DMBG for such Lot, minus closing costs paid by DMBG for the original transfer of <br />such Lot. DMBG shall exercise this option by sending written notice to the then title holder of the Lot <br />within one hundred eighty (180) days after the expiration of the above time frame or this option shall be <br />considered waived by DMBG as to the subject Lot.
