<br />CONDITIONAL ASSIGNMENT OF LEASE AS ADDITIONAL SECURITY
<br />David C. Powers and Rosemary Powers, Husband and Wife, ASSIGNORS, do hereby assign to FIVE
<br />POINTS BANK, ASSIGNEE, as additional security for payment of a loan made to Assignors by Assignee in
<br />the amount of $75,000.00, the Lease dated May 2, 1994, wherein Kuester Lake Inc. is the Lessor and
<br />Assignors are the Lessees, pertaining to the following- described premises:
<br />Lot Number Seventeen (17) having a lake front footage of Seventy-five Feet (75') situated on the
<br />West Side of West Portion of Kuester's Lake, a Part of the East Half of the Southwest Quarter (E1 /2SW1/4)
<br />of Section Thirteen (13) in Township Eleven (11) North, Range Nine (9) West of the 6th P.M., Hall County,
<br />Nebraska.
<br />It is understood that if the Assignors pay said indebtedness of $75,000.00, with interest and according to the
<br />provisions of the Financing Statement given by them to the Assignee, that this Conditional Assignment of
<br />said Lease will thereafter be null and void and of no further force nor effect.

<br />execution thereof to be their voluntary act and deed for the purposes therein stated, on the 27t' day of July,
<br />2001.
