201907112 <br />ARTICLE VIII <br />ACCESS <br />The Association, its employees and agents, shall have the right to go on any <br />Lot for the purposes of performing maintenance and repair, making inspections, and <br />performing its duties hereunder and is hereby granted as specific easement for such <br />purpose. <br />ARTICLE IX <br />GENERAL PROVISIONS <br />Section 1. Enforcement. The Association or any Owner shall have the right <br />to enforce by any proceeding at law or in equity, all restrictions, conditions, <br />covenants, reservations, liens and charges now or hereafter imposed by the provisions <br />of this Declaration. <br />Failure by the Association or by an Owner to enforce any covenant or <br />restrictions herein contained shall in no event be deemed a waiver of the right to do <br />so thereafter. <br />Section 2. Severability. Invalidation of any one of the covenants or <br />restrictions by judgment or Court order shall in no way affect any other provisions, <br />which shall remain in full force and effect., <br />Section 3. Amendments. The covenants and restrictions of this Declaration <br />shall run with and bind the land for a term of fifteen (15) years from the date that this <br />Declaration was recorded, after which time it shall be automatically extended for <br />successive periods of ten (10) years. <br />This Declaration may be amended during the first fifteen (15) years by an instrument <br />signed by the Owners of not less than seventy percent (70%) of the Lots, and <br />thereafter by an instrument signed by the Owners of not less than fifty percent (50%) <br />of the Lots. Any amendments must be recorded. <br />Section 4. Discrimination. It shall be the policy of the Park Gardens <br />Homeowners Association, including all homeowners and its Board of Directors not <br />to discriminate against anyone because of race, color, religion, age, sex, disability, <br />pregnancy, national origin, marital status, sexual orientation or other protected class <br />or characteristic established under applicable federal, state or local statute ordinance, <br />regulation or order. <br />IN WITNESS WHEREOF, the undersigned, being the Declarant herein, has <br />executed this Declaration as of the / ( day of /Vs, J e v►^ 1) -en, , 20 1 q <br />Page 12 of 1/ <br />
