201907112 ARTICLE VIII ACCESS The Association, its employees and agents, shall have the right to go on any Lot for the purposes of performing maintenance and repair, making inspections, and performing its duties hereunder and is hereby granted as specific easement for such purpose. ARTICLE IX GENERAL PROVISIONS Section 1. Enforcement. The Association or any Owner shall have the right to enforce by any proceeding at law or in equity, all restrictions, conditions, covenants, reservations, liens and charges now or hereafter imposed by the provisions of this Declaration. Failure by the Association or by an Owner to enforce any covenant or restrictions herein contained shall in no event be deemed a waiver of the right to do so thereafter. Section 2. Severability. Invalidation of any one of the covenants or restrictions by judgment or Court order shall in no way affect any other provisions, which shall remain in full force and effect., Section 3. Amendments. The covenants and restrictions of this Declaration shall run with and bind the land for a term of fifteen (15) years from the date that this Declaration was recorded, after which time it shall be automatically extended for successive periods of ten (10) years. This Declaration may be amended during the first fifteen (15) years by an instrument signed by the Owners of not less than seventy percent (70%) of the Lots, and thereafter by an instrument signed by the Owners of not less than fifty percent (50%) of the Lots. Any amendments must be recorded. Section 4. Discrimination. It shall be the policy of the Park Gardens Homeowners Association, including all homeowners and its Board of Directors not to discriminate against anyone because of race, color, religion, age, sex, disability, pregnancy, national origin, marital status, sexual orientation or other protected class or characteristic established under applicable federal, state or local statute ordinance, regulation or order.
