FAUSETT, Owner, <br />hereinafter referred to as the "Licensee". <br />1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth the <br />terms and conditions, under which the Licensee may construct, maintain, repair, and utilize the following <br />described improvement which will infringe upon property owned by the Licensor: <br />To install, maintain, and repair a 2" dewatering pipe in the public right-of-way under Stolley Park <br />Road adjacent to 509 East Stolley Park Road. Such drainage pipe shall be for groundwater <br />discharge at 509 East Stolley Park Road, which will tie into the public storm sewer on the north <br />side of Stolley Park Road, per attached Exhibit "A", dated 2019/10/15. This license agreement is <br />solely for the permission to occupy the public right-of-way with such drainage pipe and a storm <br />sewer permit shall be issued for the connection to the City storm drainage system. <br />2. DESCRIPTION OF LICENSEE'S REAL ESTATE. This Licensee Agreement applies to <br />the City right-of-way abutting the following: <br />LOT SEVEN (7), BLOCK ONE (1), ROUSH SUBDIVISION TO THE CITY OF GRAND <br />ISLAND, HALL COUNTY, NEBRASKA. <br />3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that the Licensee may <br />construct, maintain, repair and utilize the above described improvement at the Licensee's sole risk. The <br />Licensee hereby waives any claim for damages against the Licensor, its officers, employee, agents and <br />independent contractors for any damage or injury that may result to said improvement. If the Licensor, in <br />its sole discretion, determines that any part or all of the improvement must be removed or is damaged by <br />the Licensor, its employees, agents or independent contractors working for the Licensor during the <br />course of their employment or duties with the Licensor, the Licensee agrees to assume and pay all costs <br />relating to the replacement or repair of the improvement. Licensee indemnifies and holds the City <br />harmless from and against all claims arising out of the use or occupancy allowed under this agreement. <br />Licensee is responsible to contact property owner of 504 East Stolley Park Road for permission to work <br />within their property, which Licensee shall be responsible for restoration of. <br />Licensee is responsible for ensuring ice does not develop, from the discharge pipe, on the abutting <br />sidewalk and/or street, which would create a hazardous situation for the general public. <br />ON IN3W(1b1SNI SY a3/131N] <br />
