THOMAS PIRNIE AND SUSAN D. <br />PIRNIE, Owners, hereinafter referred to as the "Licensee". <br />1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth the <br />terms and conditions, under which the Licensee may construct, maintain, repair, and utilize the following <br />described improvement which will infringe upon property owned by the Licensor: <br />To install, maintain, and repair a 4" dewatering pipe in the public right-of-way under the sidewalk <br />adjacent to 927 East Phoenix Avenue, 923 East Phoenix Avenue and 919 East Phoenix Avenue. <br />Such drainage pipe shall be for groundwater discharge at 919 East Phoenix Avenue, which will <br />tie into the public storm sewer at the southeast corner of Phoenix Avenue and Sun Valley Drive, <br />per attached Exhibit "A", dated 2019/10/11. This license agreement is solely for the permission to <br />occupy the public right-of-way with such drainage pipe and a storm sewer permit shall be issued <br />for the connection to the City storm drainage system. <br />2. DESCRIPTION OF LICENSEE'S REAL ESTATE. This Licensee Agreement applies to <br />the City right-of-way abutting the following: <br />LOT THIRTEEN (13), BLOCK ONE (1) PLEASANT VIEW FOURTH ADDITION TO THE <br />CITY OF GARND ISLAND, HALL COUNTY, NEBRASKA. <br />AND <br />LOT TWELVE (12), BLOCK ONE (1), PLEASANT VIEW FOURTH ADDITION TO THE <br />CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA. <br />AND <br />LOT ELEVEN (11) AND THE EASTERLY FIVE (5) FEET OF LOT TEN (10), BLOCK ONE <br />(1), PLEASANT VIEW FOURTH ADDITION TO THE CITY OF GRAND ISLAND, HALL <br />COUNTY, NEBRASKA. <br />3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that the Licensee may <br />construct, maintain, repair and utilize the above described improvement at the Licensee's sole risk. The <br />Licensee hereby waives any claim for damages against the Licensor, its officers, employee, agents and <br />independent contractors for any damage or injury that may result to said improvement. If the Licensor, in <br />its sole discretion, determines that any part or all of the improvement must be removed or is damaged by <br />
