r- �1 <br />LICENSE AGREEMENT 90-- 106026 <br />This License Agreement is made by and between the CITY OF <br />GRAND ISLAND, NEBRASKA, a Municipal Corporation, herein referred to <br />as the "City" and RICK S. JOHNSON, a /k /a RICK'S LAWN CARE, <br />hereinafter referred to as the "Licensee ". <br />1. STATEMENT OF PURPOSE. The purpose of this License <br />Agreement is to set forth the terms and conditions under which the <br />Licensee may construct, maintain, repair, and utilize the following <br />described improvement which will infringe upon real estate owned by <br />the City: <br />An awning structure which encroaches in the public right- <br />; of. -way of Greenwich Street a distance of ten (lo') feet. <br />2. YDESCRIPTION OF LICENSEE'S REAL ESTATE. The Licensee owns <br />the following described real estate adjacent to the City's real <br />estate to which this License Agreement shall apply: <br />Part of the NE 1/4 of the NE 1/4 of Sec. 21- Townskig ll -Ra e 9 more parti- <br />cularly described: Beginning at a point on the north 1 n of Ot�ahoiha <br />Avenue, where such point intersects with the east line of <br />Greenwich Street= then running northwesterly along and <br />upon the east line of Greenwich Street, a distance of One <br />Hundred Forty -f ive and Six Hundredths feet (145.05 feet) ; <br />thence running northeasterly a distance of One Hundred <br />Twenty -one and Thirty -seven Hundredths feet (121.37 <br />feet); thence running southeasterly a distance of One s <br />Hundred Forty -four and Seventy -nine Hundredths feet <br />(144.79 feet); to a point on the north line of Oklahoma <br />Avenue= thence running southwesterly along and upon the = <br />north line of Oklahoma Avenue a distance of One Hundred- - <br />Twenty -one and Forty -three Hundredths feet (121.43 feet) <br />to the point of beginning; <br />More commonly known as 924 West Oklahoma Avenue, Grand <br />Island, Hall County, Nebraska. <br />3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed <br />that the Licensee may construct, maintain, repair and utilize the <br />above describers improvement at the Licensee's sole risk. The <br />Licensee hereby waives any claim for damages against the City, its <br />officers, employees, agents and independent contractors for any <br />damage or injury that may result to said improvement. If the City, ' <br />in its sole discretion, determines that any part or alb of the <br />improvement must be removed or is damaged by the City, its <br />employees, agents, or independent contractors working for the City <br />during the course of their employment or duties with the City, the <br />Licensee agrees to assume and pay all costs relating to the <br />replacement or repair of the improvement. <br />ti <br />r <br />
