r- �1 LICENSE AGREEMENT 90-- 106026 This License Agreement is made by and between the CITY OF GRAND ISLAND, NEBRASKA, a Municipal Corporation, herein referred to as the "City" and RICK S. JOHNSON, a /k /a RICK'S LAWN CARE, hereinafter referred to as the "Licensee ". 1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth the terms and conditions under which the Licensee may construct, maintain, repair, and utilize the following described improvement which will infringe upon real estate owned by the City: An awning structure which encroaches in the public right- ; of. -way of Greenwich Street a distance of ten (lo') feet. 2. YDESCRIPTION OF LICENSEE'S REAL ESTATE. The Licensee owns the following described real estate adjacent to the City's real estate to which this License Agreement shall apply: Part of the NE 1/4 of the NE 1/4 of Sec. 21- Townskig ll -Ra e 9 more parti- cularly described: Beginning at a point on the north 1 n of Ot�ahoiha Avenue, where such point intersects with the east line of Greenwich Street= then running northwesterly along and upon the east line of Greenwich Street, a distance of One Hundred Forty -f ive and Six Hundredths feet (145.05 feet) ; thence running northeasterly a distance of One Hundred Twenty -one and Thirty -seven Hundredths feet (121.37 feet); thence running southeasterly a distance of One s Hundred Forty -four and Seventy -nine Hundredths feet (144.79 feet); to a point on the north line of Oklahoma Avenue= thence running southwesterly along and upon the = north line of Oklahoma Avenue a distance of One Hundred- - Twenty -one and Forty -three Hundredths feet (121.43 feet) to the point of beginning; More commonly known as 924 West Oklahoma Avenue, Grand Island, Hall County, Nebraska. 3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that the Licensee may construct, maintain, repair and utilize the above describers improvement at the Licensee's sole risk. The Licensee hereby waives any claim for damages against the City, its officers, employees, agents and independent contractors for any damage or injury that may result to said improvement. If the City, ' in its sole discretion, determines that any part or alb of the improvement must be removed or is damaged by the City, its employees, agents, or independent contractors working for the City during the course of their employment or duties with the City, the Licensee agrees to assume and pay all costs relating to the replacement or repair of the improvement. ti r
