STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth the terms and conditions, under which the Licensee may construct, maintain, repair, and utilize the following described improvement which will infringe upon property owned by the Licensor: To install, maintain, and repair a 3" PVC Schedule 40 drainage discharge pipe into City of Grand Island's storm drainage system adjacent to 3754 Norseman Avenue, 3770 Norseman Avenue and 3774 Norseman Avenue. Such drainage pipe shall be for groundwater discharge at the noted parcels, which will tie into the public storm sewer on the north side of each, per attached Exhibit "A", dated 2019/10/10. This license agreement is solely for the permission to occupy City property with such drainage pipe and a storm sewer permit shall be issued for the connection to the City storm drainage system for each parcel. 2. DESCRIPTION OF LICENSEE'S REAL ESTATE. This Licensee Agreement applies to the City right-of-way abutting the following: LOT SEVEN (7), BLOCK THREE (3), STERLING ESTATES SUBDIVISION, CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA. AND LOT THREE (3), BLOCK THREE (3), STERLING ESTATES SUBDIVISION, CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA. AND LOT TWO (2), BLOCK THREE (3), STERLING ESTATES SUBDIVISION, CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA. 3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that the Licensee may construct, maintain, repair and utilize the above described improvement at the Licensee's sole risk. The Licensee hereby waives any claim for damages against the Licensor, its officers, employee, agents and independent contractors for any damage or injury that may result to said improvement. If the Licensor, in its sole discretion, determines that any part or all of the improvement must be removed or is damaged by the Licensor, its employees, agents or independent contractors working for the Licensor during the
