Baack <br />V 104 N Wheeler Avenue <br />Grand Island NE 68801-6015 <br />SECOND AMENDMENT TO DECLARATION OF CITY CENTRE CONDOMINIUMS <br />THIS SECOND AMENDMENT is made this -I 1 day of September, 2019, by the <br />undersigned, being the Declarant having developmental rights as specified in the Declaration <br />creating the condominium identified as CITY CENTRE CONDOMINIUMS, (hereinafter <br />referred to as "Declarant"). <br />WITNESSETH: <br />WHEREAS, a Declaration of CITY CENTRE CONDOMINIUMS (hereinafter referred <br />to as "the Declaration") was filed in the Office of the Register of Deeds of Hall County, <br />Nebraska, on December 5, 2018, as Instrument No. 201807839, which Declaration was recorded <br />against the following described real estate, to -wit: <br />Lots One (1), Two (2) and the Easterly two-thirds (2/3) of Lot Three (3), Block <br />Sixty -Three (63), Original Town, now City of Grand Island, Hall County, <br />Nebraska; and <br />WHEREAS, such Declaration was previously amended by an Amendment to Declaration <br />of City Centre Condominiums filed in the Office of the Register of Deeds of Hall County, <br />Nebraska on December 6, 2018, as Instrument No. 201807862; <br />WHEREAS, Section 6 of the Declaration provides that the Declarant has developmental <br />rights to add units to the condominium established by the Declaration during the period of <br />Declarant control set forth in the Declaration; <br />WHEREAS, the Declarant currently remains entitled to exercise the rights of Declarant <br />control in that it has not conveyed Ninety Percent (90%) of the existing units to unit owners <br />other than the Declarant and currently continues to offer units for sale in the ordinary course of <br />business; <br />WHEREAS, there are currently Four (4) units in CITY CENTRE CONDOMINIUMS, <br />but, by reason hereof, Declarant now increases the number of those units to Five (5) and creates <br />
