WITNESSETH: WHEREAS, a Declaration of CITY CENTRE CONDOMINIUMS (hereinafter referred to as "the Declaration") was filed in the Office of the Register of Deeds of Hall County, Nebraska, on December 5, 2018, as Instrument No. 201807839, which Declaration was recorded against the following described real estate, to -wit: Lots One (1), Two (2) and the Easterly two-thirds (2/3) of Lot Three (3), Block Sixty -Three (63), Original Town, now City of Grand Island, Hall County, Nebraska; and WHEREAS, such Declaration was previously amended by an Amendment to Declaration of City Centre Condominiums filed in the Office of the Register of Deeds of Hall County, Nebraska on December 6, 2018, as Instrument No. 201807862; WHEREAS, Section 6 of the Declaration provides that the Declarant has developmental rights to add units to the condominium established by the Declaration during the period of Declarant control set forth in the Declaration; WHEREAS, the Declarant currently remains entitled to exercise the rights of Declarant control in that it has not conveyed Ninety Percent (90%) of the existing units to unit owners other than the Declarant and currently continues to offer units for sale in the ordinary course of business; WHEREAS, there are currently Four (4) units in CITY CENTRE CONDOMINIUMS, but, by reason hereof, Declarant now increases the number of those units to Five (5) and creates
