I rn This License Agreement is made by and between the CITY OF GRAND ISLAND, NEBRASKA, a municipal Corporation, herein referred to as the "Licensor" and KRIS L. MLECZKO AND JULIA A. FOOTE, Owners, hereinafter referred to as the "Licensee". 1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth the terms and conditions, under which the Licensee may construct, maintain, repair, and utilize the following described improvement which will infringe upon property owned by the Licensor: To install, maintain, and repair a 4" dewatering pipe in the public right-of-way under the sidewalk adjacent to 831 & 825 East Delaware Avenue. Such drainage pipe shall be for groundwater discharge at 831 East Delaware Avenue, which will tie into the public storm sewer on the west side of the property addressed as 825 East Delaware Avenue, per attached Exhibit "A", dated 9/3/2019. This license agreement is solely for the permission to occupy the public right-of-way with such drainage pipe and a storm sewer permit shall be issued for the connection the City storm drainage system. 2. DESCRIPTION OF LICENSEE'S REAL ESTATE. This Licensee Agreement applies to the City right-of-way abutting the following: THE WESTERLY SIXTY FIVE (65) FEET OF LOT SIX (6) AND THE EASTERLY TWENTY ONE (21) FEET OF LOT FIVE (5), PLEASANT VIEW FIFTH SUBDIVISION TO THE CITY OF GARND ISLAND, HALL COUNTY, NEBRASKA. AND THE EASTERLY THIRTY-FOUR (34) FEET OF LOT FOUR (4) AND THE WESTERLY FIFTY TWO (52) FEET OF LOT FIVE (5), PLEASANT VIEW FIFTH SUBDIVISION, IN THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA. 3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that the Licensee may construct, maintain, repair and utilize the above described improvement at the Licensee's sole risk. The Licensee hereby waives any claim for damages against the Licensor, its officers, employee, agents and independent contractors for any damage or injury that may result to said improvement. If the Licensor, in its sole discretion, determines that any part or all of the improvement must be removed or is damaged by the Licensor, its employees, agents or independent contractors working for the Licensor during the course of their employment or duties with the Licensor, the Licensee agrees to assume and pay all costs
