I <br />rn <br />This License Agreement is made by and between the CITY OF GRAND ISLAND, NEBRASKA, a <br />municipal Corporation, herein referred to as the "Licensor" and KRIS L. MLECZKO AND JULIA A. <br />FOOTE, Owners, hereinafter referred to as the "Licensee". <br />1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth the <br />terms and conditions, under which the Licensee may construct, maintain, repair, and utilize the following <br />described improvement which will infringe upon property owned by the Licensor: <br />To install, maintain, and repair a 4" dewatering pipe in the public right-of-way under the sidewalk <br />adjacent to 831 & 825 East Delaware Avenue. Such drainage pipe shall be for groundwater <br />discharge at 831 East Delaware Avenue, which will tie into the public storm sewer on the west <br />side of the property addressed as 825 East Delaware Avenue, per attached Exhibit "A", dated <br />9/3/2019. This license agreement is solely for the permission to occupy the public right-of-way <br />with such drainage pipe and a storm sewer permit shall be issued for the connection the City <br />storm drainage system. <br />2. DESCRIPTION OF LICENSEE'S REAL ESTATE. This Licensee Agreement applies to <br />the City right-of-way abutting the following: <br />THE WESTERLY SIXTY FIVE (65) FEET OF LOT SIX (6) AND THE EASTERLY <br />TWENTY ONE (21) FEET OF LOT FIVE (5), PLEASANT VIEW FIFTH SUBDIVISION TO <br />THE CITY OF GARND ISLAND, HALL COUNTY, NEBRASKA. <br />AND <br />THE EASTERLY THIRTY-FOUR (34) FEET OF LOT FOUR (4) AND THE WESTERLY <br />FIFTY TWO (52) FEET OF LOT FIVE (5), PLEASANT VIEW FIFTH SUBDIVISION, IN <br />THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA. <br />3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that the Licensee may <br />construct, maintain, repair and utilize the above described improvement at the Licensee's sole risk. The <br />Licensee hereby waives any claim for damages against the Licensor, its officers, employee, agents and <br />independent contractors for any damage or injury that may result to said improvement. If the Licensor, in <br />its sole discretion, determines that any part or all of the improvement must be removed or is damaged by <br />the Licensor, its employees, agents or independent contractors working for the Licensor during the <br />course of their employment or duties with the Licensor, the Licensee agrees to assume and pay all costs <br />
