c <br />201905694 <br />) Make a gift, subject to the limitations of the Nebraska Uniform Power of <br />Attorney Act and any special instructions in this power of attorney <br />) Create or change rights of survivorship <br />) Create or change a beneficiary designation <br />) Delegate to another person to exercise the authority granted under this power of <br />attorney <br />) Waive the principal's right to be a beneficiary of a joint and survivor annuity, <br />including a survivor benefit under a retirement plan <br />) Exercise fiduciary powers that the principal has authority to delegate <br />) Renounce or disclaim an interest in property, including a power of appointment <br />LINIITATION ON AGENT'S AUTHORITY <br />Except as otherwise authorized by the Power of Personal and Family Maintenance, an <br />agent MAY NOT use my property to benefit the agent or a person to whom the agent owes an <br />obligation of support unless I have included that authority in the Special Instructions or the Grant <br />of Specific Authority. <br />SPECIAL INSTRUCTIONS <br />1. NONE <br />EFFECTIVE DATE <br />Power of attorney becomes effective upon disability of principal; continues in effect after <br />principal's death until notice. Pursuant to Section 30-4009 of the Nebraska Statutes, I declare <br />that this power of attorney shall become effective upon my disability or incapacity, but not until <br />then, and that the authority granted herein shall continue during any period while I am disabled <br />or incapacitated. I authorize my daughter, Jennifer Gardient, or my son, Jeffrey Becker, to <br />make such determination that I am disabled or incapacitated, if it is necessary to establish my <br />agent's authority to any person. Further, all such authority shall continue after my death, until <br />notice of such death shall have been received by my attorney so that she has actual knowledge of <br />the fact that I have died. Any action taken in good faith by said attorney during any period <br />while it is uncertain whether I am alive, before he receives actual knowledge of my death, or, in <br />any event, taken during the period while I am disabled or incapacitated, shall be as valid as if I <br />were alive, competent, and not disabled. <br />RELIANCE ON THIS POWER OF ATTORNEY <br />Any person, including my agent, may rely upon the validity of this power of attorney or a <br />copy of it unless that person knows it has terminated or is invalid. <br />Page 3 of 6 <br />
