Moeller and Geraldine M. Zrust, being first duly sworn, depose and say: <br />1. That the Affiants are the successor cotrustees under the terms and conditions of the <br />Dorothy M. Moeller Revocable Trust dated August 20, 2012, that following the death of Dorothy <br />M. Moeller became known as the Dorothy M. Moeller Administration Trust (hereinafter referred <br />to as the "said Trust"). <br />2. That on August 5, 2019, the Affiants became the successor cotrustees of the said <br />Trust following the death of Dorothy M. Moeller on July 4, 2019, the settlor and initial trustee of <br />said Trust, a certified copy of her death certificate is attached as Exhibit "A", and upon signing an <br />Acceptance to Act as Successor Cotrustees under the Dorothy M. Moeller Revocable Trust, an <br />original of which is attached as Exhibit "B". <br />3. That the Affiants remains the sole cotrustees of the said Trust as of this date. <br />4. That among the assets of the said Trust is the following described real property: <br />Lot Seven (7) in Block Four (4), in Charles Wasmer's Addition and Wasmer's <br />Annex to the First Addition to the City of Grand Island, Hall County, <br />Nebraska; and <br />The Southeast Quarter (SE%) of Section Eleven (11), Township Twelve (12) <br />North, Range Nine (9) West of the 6th P.M., Hall County, Nebraska, EXCEPT <br />a tract of land situated in the Southwest Quarter of the Southeast Quarter <br />(SW%SE'/4) of said Section 11 conveyed to Charles W. Winter and Lenore A. <br />Winter by Warranty Deed recorded in Book 163 at Page 397 of the Deed <br />Records of Hall County, Nebraska, AND EXCEPT Lot One (1) in Moeller <br />Subdivision located in the Southeast Quarter (SE%) of Section Eleven (11), <br />Township Twelve (12) North, Range Nine (9) West of the 6th P.M., Hall County, <br />Nebraska. <br />5. That pursuant to the terms of the said Trust and §30-3881(2) of the Nebraska Uniform <br />Trust Code, the cotrustees of the said Trust have the power, without court authorization, to acquire <br />or sell property, for cash or on credit, at public or private sale. <br />6.
