<br />NOTICE OF DEFAULT
<br />The undersigned, FIVE POINTS BANK, Trustee under certain Deeds of Trust dated
<br />January 13, 2000, January 9, 2013, and February 17, 2016, wherein KERRY FOSTER, A SINGLE
<br />PERSON, is the Trustor, which Deeds of Trust were filed of record in the office of the County
<br />Clerk of Hall County, Nebraska, on January 18, 2000 at Instrument No. 0200000488, on January
<br />11, 2013 at Instrument No. 201300281, and on February 19, 2016 at Instrument No. 201601025,
<br />respectively; and contain as trust property the following -described real estate:
<br />THE EAST SIXTY FEET (60') OF LOTS FOUR (4) AND FIVE (5) IN BLOCK
<br />FORTY THREE (43) IN PACKER AND BARR'S ADDITION TO THE CITY OF
<br />GRAND ISLAND, NEBRASKA AND THE COMPLEMENT TO LOT FOUR (4)
<br />BEING A TRACT OF LAND 8.9 FEET WIDE AND RUNNING ALONG AND
<br />ADJACENT AND CONTIGUOUS TO THE SOUTH SIDE OF THE EAST
<br />SIXTY (60) FEET OF LOT FOUR (4) AFORESAID AND PLATTED AS PART
<br />OF PACKER AND BARR'S ANNEX, ALL LOCATED IN THE SOUTHWEST
<br />QUARTER (S/W 1/4) OF THE SOUTHEAST QUARTER (S/E 1/4) OF SECTION
<br />SEVENTEEN (17), TOWNSHIP ELEVEN (11) NORTH, RANGE NINE (9)
<br />WEST OF THE SIXTH (6) P.M., HALL COUNTY, NEBRASKA;
<br />which is commonly known as 2502 W. Lincoln Highway, Grand Island, Nebraska 68803;
<br />together with all existing or subsequently erected or affixed buildings, improvements and fixtures;
<br />all easements, rights of way, and appurtenances; all water, water rights and ditch rights (including
<br />stock in utilities with ditch or irrigation rights); and all other rights, royalties, and profits relating
<br />to the real property, including without limitation all minerals, oil, gas, geothermal and similar
<br />matters, all of which was referred to in such Deeds of Trust as the "Real Property";
<br />hereby gives notice of default of said Trustor for the reason that said Trustor has failed to make
<br />the payments of principal and interest due in respect to the Notes secured by those Deeds of Trust,
<br />and further for the reason that said Trustor is now deceased.
<br />By reason of such default, the undersigned Trustee hereby elects to sell or cause to be sold
<br />the above Real Property to satisfy the obligations of those certain Notes dated February 17, 2016,
<br />May 17, 2018, November 30, 2018, and November 30, 2018, owing from Trustors to the
<br />Beneficiary, FIVE POINTS BANK, pursuant to the terms of the Deeds of Trust referred to above,
<br />which secures this obligation.
