201904287 <br />DECLARATION OF PROTECTIVE COVENANTS <br />CONDITIONS & RESTRICTIONS OF <br />The ORCHARD SUBDIVISION <br />KNOW ALL MEN THESE PRESENTS: <br />WHEREAS, The Orchard, LLC, a Nebraska LLC ("Developer") is the developer and owner <br />of a certain tract of real property described as: <br />The Orchard Subdivision, Grand Island, Hall County, Nebraska <br />WHEREAS, the Developer intends to fully develop the Neighborhood and has preliminarily <br />platted the Neighborhood via the appropriate platting process through the city of Grand Island, <br />Nebraska, which preliminary plat has been filed with the Planning Department of Grand Island ("The <br />Orchard). Developer has final platted the Property through the appropriate final platting process of <br />the City by final plats, which final plat 's known as The Orchard Subdivision and which was filed as <br />ya&L <br />/ <br />instrument Numbers 2019- n , in the Office of the Register of Deeds of Hall County, <br />Nebraska. The Developer shall file additional final plats of the Neighborhood predominantly (but <br />not necessarily exactly) in accord with the preliminary plat and such additional final plats shall be <br />governed by these covenants whether or not a separate filing of these covenants is made with regard <br />to such final plats. <br />WHEREAS, the Developer desires to ensure the orderly and proper development, <br />maintenance and use of the Neighborhood in order to protect and preserve the overall character of <br />the Neighborhood in accordance with its desires to develop a quality residential neighborhood, and in <br />order to provide and maintain a uniform set of rules, regulations and restrictions concerning the <br />construction and use of any structures in the Neighborhood, and in order to provide for the <br />maintenance, use and operation of the Lots and Common Areas within the Neighborhood. <br />NOW, THEREFORE, the Developer does hereby create, establish, adopt and impose the <br />following covenants, restriction, and conditions on the Neighborhood and particularly that portion of <br />the Neighborhood hereinafter described as the "Lots" or a "Lot", to -wit: <br />ARTICLE I <br />Definitions <br />A. As used herein, the term "Neighborhood" or "Property" shall be deemed to mean: <br />The Orchard Subdivision, Grand Island, Hall County Nebraska, including Lots 1 through 9 <br />Block One, Lots 1 through 20 Block Two; Lots 1 through 8, Block Three; Lots 1 through 28, Block <br />4; and Outlots A and B of such Subdivision as surveyed, platted and recorded in Hall County. <br />Together with such additional property as may be subsequently added hereto by written <br />declaration of common grantor filed with the Register of Deeds of Hall County, Nebraska. <br />1 <br />
