y <br />F- <br />89`104079 <br />THIS AGREEMENT entered into this` day of 0 <br />19890 by and between JOHN C. HOLLO!WELL, hereinafter r erred to <br />as First Party, and lei *E CORPORATION, a Nebraska Corporation, <br />hereinafter referred to as Second Party. <br />RECITALS <br />1. First Party is the owner of Lots Three (3j, Dive (5), <br />and Seven (7), in Block Fourteen (14), College Addition to west <br />Lawn, in the City of Grand island, Hall County, Nebraska. <br />2. Second Party is the owner of Lot One (1) in Block <br />Fourteen (14), College Addition to West Lawn, in the City of <br />Grand Island, Hall County, Nebraska. <br />3. All of the foregoing lots were under common ownership at <br />the time buildings were constructed on the respective lots, and a <br />common parking lot was.constructed to serve all of the <br />properties. <br />4. The parties, by this Agreement, wish to repeal the <br />"Common Area Parking Agreement" recorded as Document No. 89- <br />101716, Register of Deeds Office, Hall County, Nebraska, and to <br />make different provisions for the use and maintenance of the <br />parking lot. <br />NOW THEREFORE, in consideration of the mutual covenants and <br />agreements contained herein and for other good and valuable <br />consideration,.the receipt of which is hereby acknowledged, the <br />parties agree as follows: <br />1. Parking Lot Defined. The Recitals stated above are a <br />part of this Agreement. The parking lot located upon those parts <br />of Lots Three (3), Five (5) and Seven (7) in said College <br />Addition to West Lawn, as the parking lot presently exists on the <br />date of this Agreement is the subject of this Agreement and is <br />hereinafter referred to as the "Parking Lot ". <br />2. Common Area Parking Agreement Rescinded. First Party <br />and Second Party, being all of the owners of Lots One (1), Three <br />(3), Five (5) and Seven (7) in College Addition to West Lawn, in <br />the City of Grand Island, Hall County, Nebraska, hereby rescind, <br />revoke and repeal the "Common Area Parking Agreement" dated <br />January 23, 1989, recorded in the Hall County Register of Deeds <br />Office as Document No. 89- 101716. The parties further agree that <br />this "Agreement for License and Maintenance of Parking Lot" shall <br />replace and supersede the previous "Common Area Parking <br />Agreement ". In addition, each party agrees to execute and <br />deliver to the other party a Quitclaim Deed which conveys each <br />party's easement rights for parking lot purposes on the other's <br />property. <br />1 <br />
