BOERSEN, <br />Debtor(s). <br />Case No. BK10-43893 <br />(Chapter 7) <br />MOTION TO AVOID <br />JUDGMENT LIEN <br />regarding CITIFINANCIAL, INC. <br />with NOTICE of OBJECTION and <br />RESISTANCE DEADLINE and <br />CERTIFICATE OF SERVICE <br />COMES NOW, Debtor(s), Douglas and Angela Boersen, by and through their <br />Attorney, James H. Truell and motions the Court to avoid the judgment lien as filed by Citifinancial, <br />Inc., <br />On December 31, 2010 the above mentioned debtors filed a Chapter #7 Bankruptcy <br />and Citifinancial, Inc was listed as an unsecured nonpriority claim on Schedule F. <br />Citifinancial, Inc. filed a suit in Hall County Court, CI09-3057 against the debtors and <br />an Order of Default Judgment was entered August 4, 2009. <br />On August 24, 2009, a Transcript of Judgment was filed in Hall County District Court, <br />CI09-93 5 in the amount of $12,597.12, plus interest and Court costs. This action placed a lien on any <br />real estate owned by the debtors. <br />The Debtor's real estate, at time of the bankruptcy filling was valued at $157,122.00 <br />said real estate is secured in a Deed of Trust for $139,843.69. <br />Citifinancial, Inc. judgment impedes the debtor's homestead exemption as stated in <br />R.R.S. § 40-101. <br />WHEREFORE, Debtors pray that the Court will recognize this claim as an Unsecured <br />Nonpriority Claim, as it appears on Schedule F of the bankruptcy schedules and grant an Order to <br />Avoid Judgment Lien. <br />NOTICE OF OBJECTION AND RESISTANCE DEADLINE <br />Please take notice that on June 6, 2019, a Motion to Avoid Judgment Lien was filed <br />
