201903849 WHEREAS, this Amendment has been executed by Owners of fourteen (14) or more lots subject to the Summerfield Subdivision Declaration, constituting a majority of the Owners of the lots subject to the Summerfield Subdivision Declaration; and WHEREAS, a Declaration of Restrictive Covenants, Restrictions and Conditions for Summerfield Estates Tenth Subdivision was filed in the Office of the Register of Deeds of Hall County, Nebraska on November 9, 2017 as Instrument No. 201707665 and amended by Corrective Declaration of Restrictive Covenants, Restrictions and Conditions for Summerfield Estates Tenth Subdivision filed in the Office of the Register of Deeds of Hall County, Nebraska on April 13, 2018 as Instrument No. 201802365 ("the Tenth Subdivision Declaration"), which Tenth Subdivision Declaration was recorded against the following described real estate, to -wit: Lots Five (5) through Seventeen (17), all in Summerfield Estates Tenth Subdivision in the City of Grand Island, Hall County, Nebraska; and WHEREAS, Paragraph 2. of the Tenth Subdivision Declaration provides that the Tenth Subdivision Declaration may be changed or modified by a majority of Owners; and WHEREAS, the Owners subject to the Tenth Subdivision Declaration desire to amend the Tenth Subdivision Declaration. KNOW ALL MEN BY THESE PRESENTS: 1. The Tenth Subdivision Declaration is hereby amended by the Owners subject to the Tenth Subdivision Declaration as follows: a. Article III, Paragraph 1.a. is deleted; b. Article III, Paragraph 2.o. is amended to read as follows: "o. No campers, trailers, motor or mobile homes, recreational vehicles or trucks larger than a three-quarter (3/4) ton pickup truck shall be stored on any Lot, driveway, or on the street in front of or on the side of any Lot. No campers, trailers, motor or mobile homes, boats, recreational vehicles or trucks shall be left on streets overnight. Campers, motor homes, trailers and boats shall not be permitted to be parked on the Lots for more than 24 hours in any seven (7) day period. c. Article III, Paragraph 3. is deleted; and d. The Owners of Lots Five (5) through Seventeen (17), all in Summerfield Estates Tenth Subdivision in the City of Grand Island, Hall County, Nebraska shall hereafter be subject to the Summerfield Subdivision Declaration as herein amended. 2. The Summerfield Subdivision Declaration is hereby amended and restated by the Owners subject to the Summerfield Subdivision Declaration to read as follows and is further adopted by the Owners of Lots Five (5) through Seventeen (17), all in Summerfield Estates Tenth Subdivision in the City of Grand Island, Hall County who will hereafter be subject thereto:
