Prepared by: <br />irst Dakota National Bank <br />25 da:—Street; P -Box 156 00 <br />'ankton SD 57078-41i <br />305) 665-4906 <br />Modification of Open -End Deed of Trust <br />This Modification of Open -End Deed of Trust, dated this day of June, 2019,2�� <br />refers to and amends, in part, that Open -End Deed of Trust dated February 18, 2014, <br />hereinafter described and any and all amendments, documents, or agreements related <br />thereto that were entered into by and between the undersigned Patrick J McGuire a <br />married person and Patrick J McGuire, Trustee of Patrick J McGuire Revocable Living <br />Trust dated August 9, 2007 (hereafter collectively the "Borrower") and First Dakota <br />National Bank (hereafter "Lender"). <br />r <br />(D <br />W <br />w <br />N <br />RECITALS <br />WHEREAS, Borrower is indebted to Lender under a promissory Note in the original <br />principal amount of $75,000.00, originally made and delivered by Borrower to Lender <br />(the "Note") on February 18, 2014, payable with interest at the rate and in the manner <br />provided therein; and <br />WHEREAS, Patrick J McGuire a married person and Patrick J McGuire, Trustee of <br />Patrick J McGuire Revocable Living Trust dated August 9, 2007 (the "Trustor") have <br />previously executed and delivered to Lender a Deed of Trust dated February 18, 2014, <br />filed of record in the Office of the Register of Deeds of Hall County, State of &ouer/Jebras -& <br />Dakota, on February 18, 2014 as Instrument Number: 201400935, involving that certain <br />parcel of real property described in Exhibit "A" (the "Deed of Trust"). Said Deed of Trust <br />was assigned to US Bank National Association as Custodian/Trustee for Federal <br />Agricultural Mortgage Corporation Programs ("Holder") by Assignment of Deed of Trust <br />executed March 7, 2014 and duly recorded on March 10, 2014 in the office of the <br />Register of Deeds of Hall County, State of Couth Derma, as Instrument Number: <br />201401322; and l�ebra3�a <br />WHEREAS, Borrower has requested that Lender modify the Revolving Loan Provisions <br />Termination Date effective July 1, 2019 ("Effective Date"); and <br />NOW, THEREFORE, in consideration of the Recitals, which are incorporated by this <br />reference, and for other good and valuable consideration, the receipt and sufficiency of <br />which are hereby acknowledged, the parties hereby agree as follows: <br />1. Revise the Convertible Revolving Line of Credit Variable Rate Rider, section <br />VARIABLE RATE AND SEMI-ANNUAL PAYMENT CHANGES, subsection 1. titled <br />"Payment of Principal and Interest", paragraph "(e)" so that the Revolving Line of Credit <br />Provisions expiration date is hereby amended to July 1, 2024. <br />2. Revise the Convertible Revolving Line of Credit Variable Rate Rider, section <br />VARIABLE RATE AND SEMI-ANNUAL PAYMENT CHANGES, subsection 1. titled <br />"Payment of Principal and Interest", paragraph "(f)" so that the "Revolving Loan <br />Provisions Termination Date" is hereby amended to July 1, 2024. <br />3.
