<br />HOMESTEAD DESIGNATION DISCLAIMER
<br />In accordance with the provisions of the Nebraska Farm Homestead Protection Act,
<br />Neb. Rev. Stat. Sections 76 -1901, et seq., as a preface to the execution, and as a part of
<br />the following Deed of Trust, the undersigned Trustor, being first duly sworn, elects to
<br />Disclaim the Right to Designate a Homestead.
<br />I disclaim the right to designate a homestead on the property described in the
<br />following Deed of Trust. No part of my homestead is presently, or in the future will be,
<br />situated upon said real estate. I understand that if I establish a homestead on any part of
<br />the real estate during the time the Deed of Trust remains unsatisfied and a lien on the real
<br />estate, I shall have no right to make a designation of homestead in the event of a Trustee's
<br />sale or a foreclosure sale.

<br />THIS DEED OF TRUST is made as of the /5 day of October, 2000, by OAK
<br />FARMS, INC., a Nebraska corporation, ( "TRUSTOR "), whose mailing address is: 5701
<br />North US Highway 281, Grand Island, Nebraska 68803;
<br />and DUANE A. BURNS, Attorney at Law, ( "TRUSTEE "), whose mailing address is:

<br />and ARTHUR E. OSTERMEIER and DIXIE L. OSTERMEIER, husband and wife as joint
<br />tenants ( "BENEFICIARY "), whose mailing address is: 5701 North US Highway 281, Grand

<br />FOR VALUABLE CONSIDERATION, Trustor irrevocably transfers, conveys, and
<br />assigns to Trustee, IN TRUST, WITH POWER OF SALE, for the benefit and security of
<br />Beneficiary, under and subject to the terms and conditions of this Deed of Trust, the real
<br />property located in the Hall County, Nebraska, and legally described as follows: (the
<br />"Property"):
<br />Beginning at the Southwest corner of the North Half of the Northwest
<br />Quarter (N '/2 NW ' /a) of Section Twenty One (21), Township Twelve
<br />(12), North, Range Nine (9), West of the 6th P.M., thence South on the
<br />West line of the Section Three Hundred Seventy (370) Feet, thence
<br />East Four Hundred Twenty (420) Feet, thence North parallel to the
<br />West line of the Section Five Hundred Twenty (520) Feet, thence West
<br />Four Hundred Twenty (420) Feet to the West line of the Section, thence
<br />South One Hundred Fifty (150) Feet to the point of beginning,
<br />containing five (5) acres, more or less.
<br />TOGETHER WITH all rents, easements, appurtenances, hereditaments, interests in adjoining
<br />roads situated thereon.
