<br />belonging, unto the said Grantee and to Grantee's successors and
<br />assigns forever. And Grantor hereby covenants with the said.
<br />Grantee and with Grantee`s successors and assigns, that Grantor
<br />is lawfully seized of said premises, that they are free from
<br />encumbrance, except that owing to Grantee and in respect to
<br />unpaid real estate'taxes, and that Grantor has good right and
<br />lawful authority to sell the same; and Grantor hereby covenants
<br />to warrant and defend the title to said,premises against the law-
<br />ful claiMs'of all persons whomsoever. And the said Grantor _=-
<br />hereby relinquishes all right, title, claim and interest in and
<br />to the above - described premises.
<br />This Special Warranty Deed is given as an absolute con-
<br />veyance, the Grantor having conveyed said land to the Grantee for
<br />a fair and adequate consideration, such consideration being the
<br />complete release from personal liability for obligations secured
<br />in part by the Mortgage executed by the Grantor for the benefit
<br />of Grantee, recorded as Document No. 81- 005697 in the office of
<br />the Register of Deeds of Hall County, Nebraska.
<br />Grantor declares that this conveyance is freely and fairly
<br />made, and it is the intention of the Grantor and the Grantee that
<br />title herein to be conveyed in exchange for the release of per-
<br />sonal liability as to the Mortgage shall not merge with such
<br />Mortgage.
