201903132 <br />then required by law and by this Deed of Trust, (B) Trustee shall, <br />without demand on Trustor, after lapse of such time as may then be <br />required by law and after recordation of such notice of default and after <br />notice of sale having been given as required by law, sell the Mortgaged <br />Property at the time and place of sale fixed by it in said notice of sale, <br />either as a whole, or in separate lots or parcels or items as Trustee shall <br />deem expedient, and in such order as it may determine, at public <br />auction to the highest bidder for cash in lawful money of the United <br />States payable at the time of sale, and (C) Trustee shall deliver to such <br />purchaser or purchasers thereof its good and sufficient deed or deeds <br />conveying the property so sold, but without any covenant or warranty, <br />express or implied. The recitals in such deed of any matters or facts <br />shall be conclusive proof of the truthfulness thereof. Any person, <br />including, without limitation, Trustor, Trustee or Beneficiary, may <br />purchase at such sale and Trustor hereby covenants to warrant and <br />defend the title of such purchaser or purchasers. Trustee may postpone <br />sale of all or any portion of the Mortgaged Property by public <br />announcement at such time and place of sale, and from time to time <br />thereafter may postpone such sale by public announcement or <br />subsequently noticed sale, and without further notice make such sale at <br />the time fixed by the last postponement, or may, in its discretion, give a <br />new notice of sale. <br />v. In the event of a sale or other disposition of any such property, or any <br />part thereof, and the execution of a deed or other conveyance pursuant <br />thereto, the recitals therein of facts, such as a default, the giving of <br />notice of default and notice of sale, terms of sale, sale, purchaser, <br />payment of purchase money and any other fact affecting the regularity <br />or validity of such sale or disposition, shall be conclusive proof of the <br />truth of such facts; and any such deed or conveyance shall be <br />conclusive against all persons as to such facts recited therein. <br />vi. Beneficiary and/or Trustee shall apply the proceeds of any sale or <br />disposition hereunder to payment of the following: (1) the expenses of <br />such sale or disposition, together with Trustee's fees, reasonable <br />attorneys' fees, Beneficiary's costs, and the actual cost of publishing, <br />recording, mailing and posting notice; (2) the cost of any search or <br />other evidence of title procured in connection therewith; (3) the <br />payment of the Note secured by this Deed of Trust, the other Loan <br />Documents and all other sums due Beneficiary from Trustor; (4) all <br />other sums secured hereby; and (5) the remainder, if any, to the person <br />or persons legally entitled thereto in the order of their priority. <br />vii. Trustor hereby requests that a copy of any notice of default and that any <br />notice of sale be mailed to it at the address set forth in the introductory <br />paragraph of this Deed of Trust, or as provided pursuant to Section 3.12 <br />hereof. <br />26 <br />
