All capitalized terms shall have the <br />meaning given to them in the Loan Agreement (as defined below) unless otherwise defined <br />herein. <br />WITNES SETH: <br />ARTICLE I. — GRANTS OF SECURITY <br />Section 1.1 - Property Mortgaged. TRUSTOR HEREBY IRREVOCABLY <br />GRANTS, BARGAINS, CONVEYS, TRANSFERS AND ASSIGNS TO TRUSTEE IN <br />TRUST, WITH POWER OF SALE, for the benefit and security of Beneficiary, its successors <br />and assigns under the terms and conditions of this Deed of Trust, all of the following <br />(collectively referred to as the "Mortgaged Property"): <br />A. The real property situated in the County of Hall, State of Nebraska, <br />described in Exhibit A which is attached hereto and incorporated herein by <br />reference (the "Land"), and all estates and rights of Trustor in and to the <br />Land, together with: (i) any and all buildings, structures, improvements, <br />alterations or appurtenances now or hereafter situated or to be situated on <br />the Land (collectively, the "Improvements"); and (ii) all right, title and <br />interest of Trustor, now owned or hereafter acquired, in and to (A) all <br />streets, roads and public places, alleys, easements, rights-of-way, public or <br />private, licenses, rights of ingress and egress, vehicle parking rights and <br />public places, existing or proposed, abutting, adjacent, now or hereafter <br />used in connection with or pertaining to the Land or the Improvements; (B) <br />any strips or gores between the Land and abutting or adjacent properties; <br />(C) all options to purchase the Land or the Improvements or any portion <br />thereof or interest therein, and any greater estate in the Land or the <br />Improvements; (D) all water, water rights (whether riparian, appropriative <br />or otherwise, and whether or not appurtenant), wells and well rights, well <br />permits, springs and spring rights and reservoirs and reservoir rights <br />appurtenant to or historically used in connection with the Land and all of <br />Trustor's rights and interests under applicable state or Federal law to all <br />water, and to use or consent to use all water, contained in or available from <br />any part of the water -bearing formations underlying the Land, together with <br />all associated easements and rights-of-way, any and all rights to obtain <br />water, sewer and other services from service districts, and water stock, <br />timber, crops and mineral interests on or pertaining to the Land; (E) oil, gas <br />and other hydrocarbons and other minerals produced from or allocated to <br />the Land and all products processed or obtained therefrom, and the proceeds <br />thereof, and (F) all development rights and credits and air rights pertaining <br />to the Land (the Land, Improvements and other rights, titles and interests <br />referred to in this paragraph A being herein sometimes collectively called <br />the "Premises"); <br />B.
