STARKEY, Trust Officer, Five Points Bank, Grand Island, Nebraska, <br />being first duly sworn upon oath, deposes and states that: <br />tt <br />1. Elda R. Kohls created the Elda R. Kohls Revocable Living Trust Agreement dated <br />September 22, 2011 which she subsequently amended and restated on May 2, 2014 being the <br />Amendment and Restatement of Elda R. Kohls Trust dated May 2, 2014 which she subsequently <br />amended on August 26, 2015 (the "Elda R. Kohls Trust") wherein she designated herself as the <br />initial Trustee and designated Five Points Bank, Grand Island, Nebraska as successor Trustee. <br />2. On November 2, 2017, Elda R. Kohls executed a Resignation of Trustee thereby <br />resigning as Trustee and Five Points Bank executed an Acceptance of Successor Trusteeship on <br />November 2, 2017 thereby accepting the duties of Trustee of the said Elda R. Kohls Trust and <br />agreeing to administer said Trust in accordance with the terms of the Elda R. Kohls Trust <br />Agreement and the laws of the State of Nebraska; <br />3. From September 22, 2011 until November 2, 2017, Elda R. Kohls served as sole <br />Trustee of the Elda R. Kohls Trust. From November 2, 2017, Five Points Bank has served as <br />Trustee of said Elda R. Kohls Trust and continues to serve as Trustee of said Elda R. Kohls Trust <br />through the date hereof; <br />4. Elda R. Kohls died on February 10, 2018 and as a result of the death of Elda R. <br />Kohls, the Elda R. Kohls Trust became irrevocable; <br />5. Affiant Five Points Bank is currently serving as Trustee of the Elda R. Kohls <br />Trust and said Trust grants Affiant as Trustee all powers under the Nebraska Uniform Trust <br />Code; <br />6. The Elda R. Kohls Trust is in full force and effect as of the date hereof and <br />Affiant is serving as Trustee of the Elda R. Kohls Trust; <br />7.
