<br />MEADOWLARK ESTATES SUBDIVISION
<br />HALL COUNTY, NEBRASKA
<br />AMENDED AND RESTATED RESTRICTIVE COVENANTS
<br />WHEREAS, the undersigned, hereinafter referred to as owners, are the owners of all lots in
<br />Meadowlark Estates Subdivision, hereinafter referred to as the subdivision, located in the Southwest
<br />Quarter (S W 1 /4) of the Northeast Quarter (NE 1 /4) of Section Thirty -Two (32), Township Eleven (11)
<br />North, Range Nine (9), West of the 6th P. M., Hall County, Nebraska; and
<br />WHEREAS, the original Restrictive Covenants for the Subdivision were recorded November 28,
<br />1977 in the Register of Deeds Office, Hall County, Nebraska as Document Number 77-006859. Said
<br />original Restrictive Covenants were modified by an Amendment to Restrictive Covenants recorded
<br />January 10, 1978 in the Register of Deeds Office, Hall County, Nebraska as Document Number 78-
<br />000176 and further amended by document dated May 1, 1980, recorded as Document Number 80-
<br />002992; and further amended by document recorded February 26, 2003 as Document Number
<br />200302285 and document recorded May 3, 2004 as Document Number 200404235. The undersigned
<br />owners now desire to further amend the Restrictive Covenants by adopting these Amended and Restated
<br />Restrictive Covenants.
<br />NOW, THEREFORE, in consideration thereof, and of the mutual benefits to be derived by the
<br />owners of lots in said subdivision, and any subsequent owners, their heirs, successors, personal
<br />representatives and assigns, the owners hereby stipulate and agree that any and all lots in said subdivision
<br />sold, given, devised, transferred and conveyed shall be and the same are subject to the following
<br />Amended and Restated Restrictive Covenants, all of which shall run with the land as follows:
<br />1. All lots in the subdivision shall be zoned and used as residential lots. No structure shall be
<br />erected, altered, placed or permitted to remain on any lot other than one modern single family dwelling
<br />not to exceed two stories in height with not less than a two car garage. Only one additional accessory
<br />building shall be permitted on a lot and such building shall have the same exterior design, roof and finish
<br />as the dwelling house. Lots may not be split or divided to create additional lots. Each dwelling in the
<br />Subdivision shall only be occupied by the lot owner (no leasing allowed). Only one family may occupy
<br />a dwelling. No multi -family dwellings shall be allowed.
<br />2. The owner of each lot shall keep his house, garage, and any accessory building in good
<br />repair and appearance. The owner of each lot shall also properly maintain his yard, fences, lawn, shore
<br />line, bushes, trees and all other portions of his lot in such a manner as will be aesthetically attractive and
<br />not degrade the appearance of the subdivision.
<br />3. For purposes of front yard and side yard set back requirements, the zoning and building
<br />regulations of the City of Grand Island, Nebraska shall apply. For purpose of determining the front lot
<br />line, it shall be conclusively presumed that the front of the lot is the side which faces away from the lake.
<br />The back of the lot shall be presumed to front upon the lake.
