C.) .-try _1 r— C:t "—� c_ —4 �1 rT1 r T'� CO �7 . r7 r CO r r DO NOT WRITE ABOVE THIS LINE — FOR REGISTER OF DEEDS USE ONLY ELECTRIC TRANSMISSION RIGHT-OF-WAY EASEMENT / SOUTHERN PUBLIC POWER DISTRICT �/ PO BOX 1687, GRAND ISLAND NE 68802-1687 KNOW ALL MEN BY THESE PRESENTS, that the undersigned KABOOM, LLC, a Nebraska limited liability company for and in consideration of the amount set forth in this easement, does hereby grant unto Southern Public Power District (hereinafter the District); a public corporation whose post office address is Grand Island, Nebraska, and to its successors or assigns; the right to enter upon the lands of the undersigned, situated in the County of Hall State of Nebraska and more particularly described as follows: SEE EXHIBIT "A" ATTCHED HERETO AND BY THIS REFERENCE MADE A PART HEREOF The District shall have the right to ingress and egress across and along the grantors property for any purpose in connection with its survey, construction, operation, maintenance, inspection, repair, removal, alteration, relocation, and reconstruction of said overhead electric facilities and related equipment. The District shall have the right at any time to trim or remove such trees and underbrush as may in any way endanger or interfere with the safe construction, operation, maintenance, alteration, or reconstruction of its overhead electric facilities and equipment used in connection therewith. In granting this easement it is understood that at pole locations, only a single pole will be used, and that the location of the poles will be such as to form the least possible interference to farm operations, so long as it does not materially increase the cost of construction. Compensation for this easement shall be in the amount of $25.00 per pole and/or anchor placed on the lands of the undersigned. Payment will be made after construction plans are final and number of poles and/or anchors can be determined. Grantor will be reimbursed for all crop damage caused during construction of the line. The undersigned covenants that he is the owner of the above described lands and that the said lands are free and clear of encumbrances and liens of whatsoever character except those held by the following persons: It is further understood that, whenever necessary, words used in this instrument in the singular shall be construed to read in the plural and that words used in the masculine gender shall be construed to read in the feminine.
