E <br />rnn�177 <br />C.A <br />-4 <br />r <br />0 <br />CD <br />r <br />DO NOT WRITE ABOVE THIS LINE — FOR REGISTER OF DEEDS USE ONLY <br />1 <br />ELECTRIC TRANSMISSION RIGHT-OF-WAY EASEMENT <br />SOUTHERN PUBLIC POWER DISTRICT <br />PO BOX 1687, GRAND ISLAND NE 68802-1687 <br />N <br />(0 <br />N <br />0) <br />CO <br />KNOW ALL MEN BY THESE PRESENTS, that the undersigned CAIP, LLC, a Nebraska limited liability <br />company, for and in consideration of the amount set forth in this easement, does hereby grant unto Southern Public <br />Power District (hereinafter the District); a public corporation whose post office address is Grand Island, Nebraska, <br />and to its successors or assigns; the right to enter upon a portion of the lands of the undersigned, situated in the <br />County of Hall State of Nebraska and more particularly described on EXHIBIT "A" and as depicted on <br />EXHIBIT "B" (the "Property"). <br />The District shall have the right to ingress and egress across and along the portion of the Property within the <br />easement area as described on Exhibit A for any purpose in connection with its survey, construction, operation, <br />maintenance, inspection, repair, removal, alteration, relocation, and reconstruction of said overhead electric facilities <br />and related equipment. <br />The District at its sole cost and expense shall have the right at any time to trim or remove such trees and underbrush <br />as may in any way endanger or interfere with the safe construction, operation, maintenance, alteration, or <br />reconstruction of its overhead electric facilities and equipment used in connection therewith. <br />In granting this easement it is understood that at pole locations, only a single pole will be used, and that the location <br />of the poles will be such as to form the least possible interference to farm operations, so long as it does not <br />materially increase the cost of construction. <br />Compensation for this easement shall be in the amount of $25.00 per pole and/or anchor placed on the lands of the <br />undersigned and removal of the existing powerline, pole, and anchors. Payment will be made after construction <br />plans are final and number of poles and/or anchors can be determined. Grantor will be reimbursed for all crop <br />damage caused during construction of the line. <br />The undersigned covenants that he is the owner of the above described lands. <br />It is further understood that, whenever necessary, words used in this instrument in the singular shall be construed to <br />read in the plural and that words used in the masculine gender shall be construed to read in the feminine. <br />IN WITNESS WHEREOF, the undersigned has set his hand this _,,Z3 day of NA -1--- , 20A <br />Page 1 of 5 <br />braska Limited Liability Company <br />
