STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth the terms <br />and conditions under which the Licensee may construct, maintain, repair, and utilize the following <br />described improvement which will infringe upon real estate owned by the Licensor: <br />To access the City's public right-of-way for installation of fiber cable, per the attached exhibit "A" <br />dated 2019/3/20 and consisting of four (4) pages. <br />2. DESCRIPTION OF LICENSEE'S REAL ESTATE. The Licensee has requested such cable be <br />installed to service the described real estate subject to the Licensor's public right-of-way to which this <br />License Agreement shall apply: <br />A TRACT OF LAND CONSISTING OF PART OF THE SOUTHWEST QUARTER (SW 1/4) OF SECTION 36, <br />TOWNSHIP 12 NORTH, RANGE 9 WEST OF THE 6TH P.M., CITY OF GRAND ISLAND, HALL COUNTY, <br />NEBRASKA AND MORE PARTICULARLY DESCRIBED AS FOLLOWS: <br />COMMENCING AT THE SOUTHWEST CORNER OF SECTION 36; THENCE ON AN ASSUMED BEARING <br />OF S89°56'37"E ALONG AND UPON THE SOUTH LINE OF THE SOUTHWEST QUARTER (SW 1/4) OF <br />SAID SECTION 36 A DISTANCE OF 52.24 FEET; THENCE N00°03'23"E A DISTANCE OF 33.00 FEET TO <br />THE POINT OF BEGINNING, POINT ALSO BEING ON THE NORTH RIGHT-OF-WAY (4.O.W.) LINE OF <br />AIRPORT ROAD; THENCE N01°18'05"W PARALLEL WITH THE WEST LINE OF SAID SW 1/4 A <br />DISTANCE OF 1171.87 FEET; THENCE N 44°09'51"E A DISTANCE OF 615.35 FEET; THENCE S89°56'37"E <br />PARALLEL WITH THE SOUTH LINE OF SAID SW 1/4 A DISTANCE OF 783.92 FEET; THENCE S45°49'47"E <br />A DISTANCE OF 263.11 FEET; THENCE S01°18'05"E PARALLEL WITH SAID WEST LINE OF THE SW 1/4 <br />A DISTANCE OF 1430.65 FEET TO SAID NORTH R.O.W. LINE OF AIRPORT ROAD; THENCE <br />N89°56'37"W ALONG AND UPON SAID NORTH LINE AND PARALLEL WITH SAID SOUTH LINE OF <br />THE SW 1/4 A DISTANCE OF 1407.24 FEET TO THE POINT OF BEGINNING. SAID TRACT CONTAINS <br />2,156,598.27 SQUARE FEET OR 49.509 ACRES MORE OR LESS. <br />3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that the Licensee may <br />construct, maintain, repair and utilize the above described improvement at the Licensee's sole risk.
