201901749 RETURN TO: Grand Island Abstract, 704 W 3rd St, PO Box 627, Grand Island, NE 68802 Mutual Termination Agreement WHEREAS, on January 22, 2015, the Wood River Recreational Association, Inc. deeded certain real estate to the City of Wood River which Deed contained conditions and was dated January 19, 2015 and recorded with the Register of Deeds Office, Hall County, Nebraska as Instrument No. 201500464; and WHEREAS, the City of Wood River has given notice to the Wood River Recreational Association, Inc. that the City of Wood River will no longer maintain and operate the property as a public golf course on a full-time basis; and WHEREAS, the parties have agreed to sell the property and have obtained a mutually acceptable buyer for said property. NOW THEREFORE, 1. The Wood River Recreational Association, Inc. and the City of Wood River mutually agree to release each other from all conditions contained in the Deed dated January 19, 2015 and recorded with the Hall County Register of Deeds as Instrument No. 201500464 for the property described as: Lots One (1) and Two (2) on Mainland, and the Northwest Quarter of the Northwest Quarter (NW 1/4 NW 1/4), all in Section Thirty -Three (33), in Township Ten (10) North, Range Eleven (11) West of the 6 P.M., Hall County, Nebraska. 2. The Wood River Recreational Association, Inc. acknowledges that it has received $299,434.75. and the City of Wood River acknowledges it has received $0.00 proceeds of the sale as the net proceeds did not exceed $315,000. 3. The Wood River Recreational Association, Inc. and the City of Wood River each release any claim they may have upon the other as a result of the Deed dated January 19, 2015 and recorded in the Hall County Register of Deeds Office on January 22, 201"nd record as Instrument No. 201500464.
