CURRY, OF COUNSEL Re: Notice to Exercise or Waive Right of First Refusal This correspondence shall serve as notice to you that SMB, LLC has received an offer for the purchase of that certain real property located in the Southwest Quarter (SW 1) of the Northwest Quarter (NW %) of Section Eight (8), Township Twelve (12) North, Range Eleven (11) West of the 6th P.M., Hall County, Nebraska, together with all appurtenances thereto, which is commonly known as 7687 N 130th Road, Cairo, Nebraska. The purchase offer received by SMB, LLC is in the amount of Two Hundred, Five Thousand Dollars ($205,000.00). Per the terms of the right of first refusal granted to you under that certain Quitclaim Deed from Donald J. Schultz and Darlene A. Schultz to Matthew R. Schultz and Michael J. Schultz, dated December 27, 2012 and recorded in the Office of the Hall County Clerk on December 28, 2012 as Instrument No. 201211128, if you desire to exercise your right to purchase the subject property under the same terms as the offer received by SMB, LLC, you must provide written notice to SMB, LLC within thirty (30) days of your receipt of this letter along with proof of your means to complete said purchase and you must be able to close on your purchase of the subject property within ninety (90) days of your receipt of this letter. If you fail to satisfy either of these conditions, your right of first refusal will be waived and SMB, LLC will proceed with the sale of the subject property. If you intend to exercise your right of first refusal, please forward written notice to my office using the contact information above. You may also provide written notice to SMB, LLC of your desire to waive your right of first refusal. Should you choose to waive that right, you may sign and date the enclosed Waiver of Right of First Refusal form in front of a Notary Public and return the same to my office.
