CURRY, OF COUNSEL <br />Re: Notice to Exercise or Waive Right of First Refusal <br />This correspondence shall serve as notice to you that SMB, LLC has received an offer for <br />the purchase of that certain real property located in the Southwest Quarter (SW 1) of the Northwest <br />Quarter (NW %) of Section Eight (8), Township Twelve (12) North, Range Eleven (11) West of <br />the 6th P.M., Hall County, Nebraska, together with all appurtenances thereto, which is commonly <br />known as 7687 N 130th Road, Cairo, Nebraska. The purchase offer received by SMB, LLC is in <br />the amount of Two Hundred, Five Thousand Dollars ($205,000.00). <br />Per the terms of the right of first refusal granted to you under that certain Quitclaim Deed <br />from Donald J. Schultz and Darlene A. Schultz to Matthew R. Schultz and Michael J. Schultz, <br />dated December 27, 2012 and recorded in the Office of the Hall County Clerk on December 28, <br />2012 as Instrument No. 201211128, if you desire to exercise your right to purchase the subject <br />property under the same terms as the offer received by SMB, LLC, you must provide written notice <br />to SMB, LLC within thirty (30) days of your receipt of this letter along with proof of your means <br />to complete said purchase and you must be able to close on your purchase of the subject property <br />within ninety (90) days of your receipt of this letter. If you fail to satisfy either of these conditions, <br />your right of first refusal will be waived and SMB, LLC will proceed with the sale of the subject <br />property. If you intend to exercise your right of first refusal, please forward written notice to my <br />office using the contact information above. <br />You may also provide written notice to SMB, LLC of your desire to waive your right of <br />first refusal. Should you choose to waive that right, you may sign and date the enclosed Waiver <br />of Right of First Refusal form in front of a Notary Public and return the same to my office. <br />
