AFFIDAVIT <br />STATE OF NEBRASKA ) <br />ss. <br />COUNTY OF HALL ) <br />1 <br />9o-- 105520 <br />Affiant, DARYL D. REFER, after being duly sworn upon oath, <br />does depose and state as follows: <br />1. That affiant is the surviving spouse of ARLINE H. REFER, <br />who departed this life on November 25, 1989, as shown by the copy <br />of the death certificate attached hereto as Exhibit `A" and by <br />this reference incorporated herein; that affiant and the said <br />ARLINE H. REFER were husband and wife on the date of decedent's <br />death on November 25, 1989. <br />2. That on the date of death, the affiant and decedent were <br />the sole owners as joint tenants with rights of survivorship of <br />that real estate located at Rural Route 2, Box 74, Grand Island, <br />Nebraska 68803, and legally described as follows: <br />A tract of land located in Lot One (1) and Two (2) <br />Mainland, Section Eleven (11), and Lot Three (3) and <br />Four (4) Island, Section Eleven (11), All in Township <br />Ten (10) North, Range Ten (10) West of the 6th P.M., <br />Hall County, Nebraska, and more particularly described <br />as follows: <br />Beginning at the Northwest Corner of Mainland <br />Section 11, T 10 N, R 10 W; thence S 89014100" E <br />along the North line of said Mainland Section 11 <br />a distance of One Thousand Five Hundred Ninety - <br />Three and Fourteen Hundredths (1593.14) Feet; <br />thence S 0027115" W a distance of Eight Hundred <br />Fifty -Five and Thirty -Eight Hundredths (855.38) <br />feet; thence N 89037100" W a distance of One <br />Thousand Five Hundred Ninety -Two and Five Hun- <br />dredths (1592.05) Feet to a Point on the West <br />Line of the Northwest puarter of said Mainland <br />Section 11, thence N 00 23' 00" E along the West <br />line of the Northwest Quarter of said Mainland <br />Section 11 a distance of Eight Hundred Sixty -Six <br />and Four Hundredths (866.04) Feet to the Point of <br />beginning; said tract containing 31.47 acres more <br />or less, of which 0.66 acre more or less is <br />reserved for County Road Purposes. <br />3. That by virtue of the survivorship of affiant, affiant <br />became the sole owner of the above - described property. <br />4. -:hat this Affidavit is given as evidence that pursuant <br />to Neb. Rev. Stat:. section 77 -2003 (1983 Sup*.,.). no inheritac.ce <br />tax lien arising due to the debatft of Decedent can attach to. -- ne <br />above- de "x:ribed real est:.ate and that pursuant: to N'eb- Rev.
