201900197 <br />EASEMENT <br />KNOW ALL MEN BY THESE PRESENTS, that MCGUIRE APPRAISALS L.L.0 <br />AND GREGORY M. CRAMER AND SHANNILEE BARNHART CRAMER, Husband and <br />Wife, hereinafter called the GRANTORS; in consideration of <br />($ -E9 ), receipt of which is hereby acknowledged, do hereby give, grant, and <br />convey unto the CITY OF WOOD RIVER, NEBRASKA, a municipal corporation, <br />hereinafter called GRANTEE, a perpetual easement over, across, under, through, and <br />upon the following -described real estate, to -wit: <br />The West 10 Feet of Lot 11, Block 20, Original Town of Wood River, <br />Hall County, Nebraska containing 1,003.0 Square Feet More or Less. <br />Said easement includes but is not limited to the right to install, construct, <br />maintain, replace, and operate public utility facilities by the GRANTEE in, on, over, or <br />under the described easement area in connection with its public utility systems. It is <br />further provided that said easement shall be deemed to provide the GRANTEE with the <br />right of unrestricted access to its public utility facilities by ingress and egress over, <br />across, through, and under the lands described herein, together with all rights of ingress <br />and egress necessary for the full and complete use, occupation, and enjoyment of the <br />easement hereby granted, including the right to excavate and refill ditches and <br />trenches for the location of said facilities and appurtenant structures related thereto, and <br />hereby prohibiting the planting of trees, bushes, and shrubs, or placing other <br />obstructions, in, upon, above, along, over, across, underneath, and through the <br />easement area. <br />To have and to hold the same unto the said GRANTEE and its successors and <br />assigns as appurtenant to the land and every part thereof; and the GRANTORS hereby <br />dedicate their respective interests in said real estate to the use of the GRANTEE. This <br />easement is perpetual and shall run with the land. <br />The GRANTORS do hereby covenant with the GRANTEE that they are lawfully <br />seised and possessed of the real estate described herein; that they have a good and <br />lawful right to convey such real estate; that such real estate is free from encumbrance; <br />and that they will warrant and defend the title thereto against the lawful claims of all <br />persons whomsoever. <br />Dated this <br />a <br />day of <br />1 <br />Page 35 <br />, 2-95- l9 <br />
