For the purpose of inducing any party to act in accordance with the powers granted in this durable power of attorney, I hereby represent, warrant, and agree that 1 and my heirs, distributees, legal representatives, successors, and assigns will hold such party or parties harmless from any loss suffered, or liability incurred, by such party or parties in acting in accordance with this durable power of attorney prior to that party's receipt of written notice of any termination. Any third party dealing in good faith with my agent may conclusively rely upon, and need not inquire into, my capacity at the time this durable power of attorney is created, or at the time any action is taken pursuant to this durable power of attorney. 8. I understand the importance of this durable power of attorney. I recognize that my agent is granted broad power to hold, administer, and control my assets, and that this durable power of attorney will become effective immediately on execution and will continue indefinitely until specifically revoked or terminated by death, even if I later become incapacitated. 9. I intend by this power of attorney to avoid any necessity of a conservatorship. However, if at any time a conservatorship of my estate is deemed necessary, I hereby nominate Gaylene M. Brennan as conservator of my estate. If Gaylene for any reason does not serve, I hereby nominate David G. Scoggins to serve as conservator of my estate.
