Kitten pursuant to a document dated June 10, 1977, and <br />filed August 26, 1977, as Document No. 77- 004883 in the records of Hall County, <br />State of Nebraska; <br />WHEREAS, Clarence I. Hoffman and James J. Kitten did assign said Lease to <br />Poland Oil, Inc., a Nebraska corporation, pursuant to a document dated August 30, <br />1983, and filed April 14, 1987, as Document No. 87- 102060, in the records of <br />Hall County, State of Nebraska; <br />WHEREAS, on December 29, 1995, Poland Oil, Inc., merged into Sapp <br />Brothers Petroleum, Inc., the surviving corporation; <br />WHEREAS, on March 5, 1990, USA Inns purchased Lot One (1) in Krug <br />Subdivision, Hall County, Nebraska, pursuant to a Warranty Deed filed May 7, <br />1990, as Document No. 90- 102480, in the records of Hall County, State of <br />Nebraska; <br />NOW, THEREFORE, in consideration of the mutual covenants and conditions <br />contained herein and for other good and valuable consideration, the receipt and <br />adequacy of which is hereby acknowledged, the parties hereto agree as follows: <br />1. The Lease is hereby terminated effective the date of this Agreement, <br />and said Lease shall have no further legal force or effect, and by this Agreement <br />shall be rendered null and void. <br />2 <br />
