Watton, Successor Trustee of the Dorothy L. Sharp and Carl E. Sharp Revocable <br />Trust dated September 15, 2005, being first sworn, depose and state pursuant to §30-38,102 and <br />§30-38, 103 of the Nebraska Uniform Trust Code: <br />1. On September 15, 2005, Dorothy L. Sharp and Carl E. Sharp created the Dorothy L. <br />Sharp and Carl E. Sharp Revocable Trust Under Agreement Dated September 15, 2005 ("the <br />Trust"). <br />2. Dorothy L. Sharp died on November 5, 2017. A photocopy of the death certificate <br />showing the date of death of Dorothy L. Sharp is attached to this Affidavit. <br />3. As a result of the death of Dorothy L. Sharp, the Dorothy L. Sharp and Carl E. Sharp <br />Revocable Trust, became irrevocable and is now known as the Dorothy L. Sharp and Carl E. Sharp <br />Irrevocable Trust. <br />4. This Affidavit is given in connection with the chain of title to the following described <br />real estate (the Property): <br />Lot Thirteen (13), Imperial Village Seventh Subdivision, in the city of Grand <br />Island, Hall County, Nebraska; <br />AND <br />The Northeast Quarter (NE1/4) of Section Twenty -One (21), Township Twelve <br />(12) North, Range Ten (10), West of the 6th P.M., Hall County, Nebraska. <br />5. Carl E. Sharp has declined to serve as Trustee of the Dorothy L. Sharp and Carl E. Sharp <br />Irrevocable Trust. <br />6. On November 20. 2017, Barbara A. Watton was appointed Successor Trustee of the <br />Dorothy L. Sharp and Carl E. Sharp Irrevocable Trust, and remains Successor Trustee as of this date. <br />Barbara A. Watton, as the Trustee, is therefore vested with the legal title to the Property without <br />the need for conveyance or transfer thereto from the prior trustee, and has lawful authority to <br />convey or distribute the same. <br />7. Pursuant to the terms of the Trust and §30-3881 of the Nebraska Uniform Trust Code, <br />the Trustee of the Trust (including any Successor Trustee) has the power, without Court <br />authorization, to acquire or sell property, for cash or on credit, at public or private sale, and the <br />power, without Court authorization, to borrow money, including from the trustee, with or without <br />ON IN3 Vfl ISNl SY 031131143 <br />
