201807442 <br />destroyed Improvement to be replaced or restored to its original condition or such other <br />condition as may be approved in writing by the DRC or (ii) the Owner shall cause the damaged <br />or destroyed Improvement to be demolished and the Lot to be suitably landscaped, so as to <br />present a pleasing and attractive appearance. <br />3.7 Review Fee. <br />The DRC shall have the right to charge a fee for reviewing requests for approval of any <br />Construction or Modification, which fee shall be payable at the time the application for approval <br />is submitted to the DRC. The fee charge by the DRC may include the actual or estimated fees or <br />costs incurred or anticipated to be incurred by the DRC in consulting with, or having the <br />application reviewed by, architects, engineers, or other professionals. The Association may <br />retain architects, engineers or other professionals as deemed necessary to review applications or <br />otherwise assist the DRC. <br />3.8 New Construction. <br />All Improvements constructed on Lots shall be of new construction, and no buildings or <br />other structures shall be removed from other locations on to any Lot. The following architectural <br />standards have been adopted by the Declarant: (a) Home Size. With the Exception of Lot One <br />(1), Copper Creek Estates Thirteenth Subdivision, which must be granted a variance in <br />reduction of the required minimum square footage upon request of the owner if necessary <br />due to location of communication lines and tower facilities on such lot, homes shall contain a <br />minimum square footage, exclusive of other accessory structures, of 1,100 square feet of fully - <br />enclosed living area on the main level. (b) Roof Pitch. The roof pitch for homes shall be at least <br />a 4/12 pitch. (c) Roofing Material. The roof material shall be of at least 30 -year architectural <br />asphalt shingles. The roof shall be a color to compliment the Residence as determined by the <br />DRC. (d) Home Siding. The siding of the Residence and any ancillary buildings shall be of <br />cement board material, with a maximum exposure of 8 inches of LAP, with both the Residence <br />and ancillary buildings matching in color. <br />3.9 No Warranty. <br />The approval by the DRC of any Construction or Modification shall not be deemed a <br />warranty or representation by the DRC as to the quality of such Construction or Modification or <br />that such Construction or Modification conforms to any applicable building codes or other <br />federal, state, or local law, statute, ordinance, rule, or regulation. The DRC shall not be liable or <br />bear any responsibility for (a) ensuring the structural integrity, quality, soundness, or <br />workmanship of any Construction or Modification approved by the DRC, (b) ensuring <br />compliance with building codes or other governmental requirements, or (c) ensuring that all <br />Improvements are of comparable quality, value, size, or structural integrity. <br />3.10 Conditional Approval. <br />The DRC may condition its approval of plans and specifications upon the agreement by <br />the Owner submitting such plans and specifications to furnish to the Association a bond or other <br />security acceptable to the DRC in an amount determined by the DRC to be reasonable sufficient <br />to (a) assure the completion of the proposed Construction or Modification, or the availability of <br />Page 19 of 67 <br />
