201807442 <br />1.36 "Plat" means (a) the initial subdivision and all additional subdivisions intended to be part <br />of the Copper Creek Estates Final Phases Project, and all amendments, supplements, and <br />corrections thereto; and (b) any plat Recorded against any part of the Additional Property that is <br />subsequently included and subjected to this Declaration pursuant to Section 2.2, and all <br />amendments, supplements, and corrections thereto. <br />1.37 "Property" or "Project" means the Initial Covered Property and all portions of the <br />Additional Property that are subsequently included and subjected to this Declaration pursuant to <br />Section 2.2. <br />1.38 "Purchaser" means any Person, other than the Declarant, who becomes the Owner of a <br />Lot by means of a voluntary transfer, except for (a) a Person who purchases a Lot and then leases <br />it to the Declarant for use as a model in connection with the sale of other Lots; (b) a Person who, <br />in addition to purchasing a Lot, is assigned any or all of the Declarant's rights under this <br />Declaration; or (c) a Designated Builder. <br />1.39 "Recording" or "Record" means placing an instrument of public record in the office <br />maintained for recording documents affecting real property in Hall County, Nebraska, and <br />"Recorded" means having been so placed of public record. <br />1.40 "Regular Assessment" means an assessment levied pursuant to Section 8.2. <br />1.41 "Residence" means any building or portion of a building situated upon a Lot and <br />designed and intended for independent ownership and for use and occupancy as a residence. <br />1.42 "Resident" means each person occupying or residing in any Residence. <br />1.43 "Special Assessment" means any assessment levied pursuant to Section 8.3. <br />1.44 "Subdivision Assessment" means any assessment levied pursuant to Section 8.4. <br />1.45 "Subdivision Assessment Area" means a portion of the Project designated in a <br />Supplemental Declaration as an area containing Subdivision Common Areas or as an area in <br />which the Association will provide Subdivision Services. <br />1.46 "Subdivision Common Area" means any part of the Common Area that is designated in <br />a Supplemental Declaration as being for the sole or primary benefit of the Owners and Residents <br />of a particular part of the Project. Subdivision Common Areas may include, without limitation, <br />drainage or retention areas, landscape medians, and areas designated as parks. <br />1.47 "Subdivision Expenses" means the actual or estimated expenses, including allocations <br />to reserves, incurred or anticipated to be incurred by the Association for the maintenance, repair, <br />and replacement of Subdivision Common Areas or to provide Subdivision Services to the <br />Owners and Residents in a Subdivision Assessment Area. <br />1.48 "Subdivision Services" means services designated in a Supplemental Declaration as <br />being for the sole or primary benefit of the Owners and Residents of a particular part of the <br />Page 12 of 67 <br />
