Connick <br />Smith, Johnson, Baack, Placzek, <br />Allen, Connick & Hansen <br />104 N Wheeler Ave. <br />Grand Island, NE 68801 <br />NOTICE OF LANDSCAPING <br />NOTICE IS HEREBY GIVEN that pursuant to a certain Real Estate Development <br />Agreement dated August 13, 2018 by and between Prataria Ventures, LLC, a Nebraska limited <br />liability company, ("Prataria") and Ponderosa Lake Estates Homeowners Association, Inc., a <br />Nebraska nonprofit corporation ("Ponderosa"), Prataria agreed to install and maintain certain <br />landscaping. Specifically, Prataria agreed as follows: <br />When Prataria, or its assigns, develops Block 3, Ponderosa Lake Estates Third <br />Subdivision, City of Grand Island, Hall County, Nebraska (the "Block 3 Property"), <br />Prataria, or the then owner of the Block 3 Property, agrees to install and maintain certain <br />landscaping between the Block 3 Property and Outlot C. Such landscaping shall consist <br />of a row or rows of evergreen trees to serve as a buffer between the development and the <br />Ponderosa Lake Estates real estate. The evergreen trees to be planted shall be capable of <br />growing to a height of at least 18 to 20 feet and shall be disease resistant. The obligation <br />to maintain the landscaping hereunder shall include the portion of the 20' wide Outlot C <br />that may be landscaped following installation of any utilities in the Outlot and the <br />approximately 10' strip of the Ponderosa property located east of Ponderosa's masonry <br />wall lying along the border of Outlot C. For purposes of this landscaping obligation, <br />development of the Block 3 Property shall be deemed to occur once a certificate of <br />occupancy is provided following the construction of a building or buildings upon the <br />Block 3 Property. The landscaping shall be added as soon as reasonably practicable <br />following development of the Block 3 Property with due consideration given to the <br />season and whether such landscaping can be added at that time. The landscaping <br />obligations provided for herein shall run with the Block 3 Property. <br />The Block 3 Property is now a part of the following described real estate: <br />Lot One (1), Ponderosa Lake Estates Seventh Subdivision in the City of Grand Island, <br />Hall County, Nebraska as shown on the Plat recorded as Document No. 201807203 (the <br />"Subject Property") <br />THIS NOTICE shall be filed with the Office of the Register of Deeds of Hall County, <br />Nebraska and indexed against the Subject Property and the aforesaid landscaping obligations <br />shall run with the Subject Property. <br />PONDEROSA LAKE ESTATES <br />HOME WNERS ASSOCIATION, INC. <br />By: C %? <br />Pam Jardine <br />President <br />"Ponderosa" <br />Page 1 of 2 <br />
