COUNTY OF HOWARD : The undersigned affiant upon being first duly sworn, does hereby deposes and states: 1. Hazel Sidwell, deceased, owned the interest in the following real estate on the date of her death: South Fifty -Four (54) feet of Lot Five (5), Block Twelve (12), Schimmer's Addition to the City of Grand Island, Hall County, Nebraska 2. The value of the Decedent's interest in all real property in the decedent's estate located in this state does not exceed twenty -five thousand dollars. The value of the decedent's interest shall be determined from the value of the property as shown on the assessment rolls for the year in which the decedent died and the Hall County assessor shows the value for the above real estate to be $17,500.00. 3. Thirty days have elapsed since the death of the Decedent, which was on July 6, 2001, as shown in a certified copy of the Decedent's death certificate attached to this affidavit. 4. No application or petition for the appointment of a personal representative is pending or has been granted in any jurisdiction. 5. Pursuant to Nebraska Probate Code Section §30- 24,129, Affiant is entitled to the real property by reason of a devise under the will of the decedent. 6. Affiant has made an investigation and has been unable to determine any subsequent will. 7. No other person has a right to the interest of the Decedent in the above described property. 8. Affiant's entitlement is based upon Affiant's status as heir and niece of Decedent, and based on the fact that the entire estate of the Decedent does not exceed $25,000.00. 9.
