Wheeler Ave <br />Grand Island NE 68801 <br />NOTICE OF DEFAULT <br />171 <br />c..., <br />_r: rTi <br />C) <br />The undersigned, FIVE POINTS BANK, TRUSTEE under a certain Deed of Trust dated <br />January 13, 2005, wherein MICHAEL J. WESTERBY and MANDY WESTERBY, husband and <br />wife, are the Trustors, which was filed for record in the office of the Register of Deeds of Hall <br />County, Nebraska on January 20, 2005 as Instrument No. 200500526, as modified by: (i) a <br />certain Modification of Deed of Trust dated April 18, 2013 and filed for record in the office of <br />the Register of Deeds of Hall County, Nebraska on April 22, 2013 as Instrument No. 201303118; <br />and (ii) a certain Modification of Deed of Trust dated April 18, 2014 and filed for record in the <br />office of the Register of Deeds of Hall County, Nebraska on April 22, 2014 as Instrument No. <br />201402354, and contains as trust property the following -described real estate: <br />Lot One (1) in Janisch Subdivision, City of Grand Island, Hall County, Nebraska, <br />excepting a certain tract more particularly described in Warranty Deed recorded <br />as Document No. 200316341; <br />which is commonly known as 1403 South Locust Street, Grand Island, Nebraska; <br />together with all existing or subsequently erected or affixed buildings, improvements and <br />fixtures; all easements, rights of way, and appurtenances; all water, water rights and ditch rights <br />(including stock in utilities with ditch or irrigation rights); and all other rights, royalties, and <br />profits relating to the real property, including without limitation all minerals, oil, gas, geothermal <br />and similar matters, all of which was referred to in such Deed of Trust as the "Real Property"; <br />hereby gives notice of default of said Trustors for the reason that said Trustors have failed to <br />make the payments of principal and interest due in respect to the Promissory Note secured by <br />that Deed of Trust. <br />By reason of such default, the undersigned Trustee hereby elects to sell or cause to be <br />sold the above Real Property to satisfy the obligations of that certain Promissory Note dated <br />August 5, 2016, and all extensions and modifications thereto, owing from to the Beneficiary, <br />FIVE POINTS BANK, pursuant to the terms of the Deed of Trust referred to above, which <br />secures this obligation. <br />FIVE POINTS BANK, Trustee <br />By: <br />Brandon S.
