201807145 AFFIDAVIT OF LOST ASSIGNMENT The undersigned, Shanna Delgado, being duly sworn deposes and states as follows: 1. That she is a Vice President for KeyBank National Association having a place of business at 4910 Tiedeman Road, Brooklyn, Ohio 44144, and is an officer duly authorized to make this affidavit 2. That she has personal knowledge of the facts set firth in this Affidavit. 3. That Westbank successor by merger to NewAlliance successor by merger to First Niagara Bank NA now known as KeyBank National Association, Current Mortgagee/ Beneficiary, is the owner and holder of a certain mortgage or deed of trust dated January 17, 2006 made by David D Roth and Debra Roth, husband and wife; Douglas L Roth and Tracey Roth, husband and wife; Marvin L Roth, a single person as mortgagor to The State Bank of Cairo now known as Pathway Bank, Original Mortgagor/Beneficiary, which mortgage or deed of trust was recorded on January 19, 2006, in the Hall County, Nebraska records in Book/Docket -, Page -, with an Instrument # of 200600509. That said Current Mortgagee/ Beneficiary owns and holds said mortgage or deed of trust as a result of sale thereof to The State Bank of Cairo now known as Pathway Bank and that said Current Mortgagee/ Beneficiary is successor in interest to Westbank successor by merger to NewAlliance successor by merger to First Niagara Bank NA now known as KeyBank National Association 4. The subject premises are known as: 12368 W Airport Rd Cairo, NE 68824. 5. That she has examined the files and records of Current Mortgagee/ Beneficiary relating to the Mortgage or Deed of Trust. 6. That said files assigning the obligation to Westbank successor by merger to NewAlliance successor by merger to First Niagara Bank NA now known as KeyBank National Association but does not contain a recorded or an original unrecorded instrument of assignment from Original Mortgagee/Beneficiary to The State Bank of Cairo now known as Pathway Bank. 7. That the Assignment was lost, misplaced or destroyed before the same could be placed of record. 8. That Current Mortgagee is the owner of the mortgage and the note secured thereby, and has not further assigned or transferred said note and mortgage to any other party. 9. That this affidavit is made to induce the Hall County, Nebraska Register of Deeds, to accept for recording a satisfaction of the mortgage, executed and acknowledged by Current Mortgagee/Beneficiary as assignee of the Mortgage or Deed of Trust.
