<br />Jerry J. Grossart, being first duly sworn upon his oath, deposes and says:
<br />1. That the Affiant was the Trustee of the Zola M. Grossart Irrevocable Trust Dated
<br />February 25, 1987 (herein the "Trust "), which Trust is a testamentary trust created under the terms
<br />and conditions of the last will and testament of Zola M. Grossart (herein "the Will"),whichWillwas
<br />probated in the County Court of Greeley County, Greeley, Nebraska, Case No. 2201.
<br />2. That on October 16, 2013, the Affiant executed his Resignation as Trustee of the
<br />Trust, a copy of which resignation is marked Exhibit "A" and by reference made a part hereof.
<br />3. That under the terms and conditions of the Will, upon the death, inability or
<br />resignation of Jerry J. Grossart to act as Trustee, Steven J. Grossart was nominated to act as Trustee
<br />of the Trust. That on October 16, 2013, Steven J. Grossart refused to act as Trustee, a copy of which
<br />Refusal to Act as Trustee is marked Exhibit `B' and by reference made a part hereof.
<br />4. That under the terms and conditions of the Will, upon the refusal of Steven J.
<br />Grossart to act as Trustee of the Trust, the Beneficiariesof the Trust, namely Sandra L. Luft, Lori
<br />L. Sextro and Kelli J. Bauer, were granted authority and right to name a successor Trustee of the
<br />Trust and that on October 24, 2013, all of the aforesaid Beneficiaries appointedLori L. Sextro to
<br />act as Trustee of the Trust, which Appointment was Accepted by the said Lori L. Sextro, a copy of
<br />which Appointmentand Acceptance to Act as Trustee of the Trust is marked Exhibit "C" attached
<br />hereto and be reference made a part hereof.
<br />5. That Lori L. Sextro, remains the Trustee of the said Trust as of this date.
<br />6. That among the assets of the said Trust is the following described real property:
<br />Lot Twelve (12), Nottingham Estates Subdivision, Hall County,
<br />Nebraska.
<br />7. That pursuant to the terms of the Will and §30- 3881(2) of the Nebraska Uniform
<br />Trust Act, the Trustee of the Trust, Lori L. Sextro, has the power, without court authorization, to
<br />acquire or sell property, for cash or on credit, at public or private sale.
<br />8. That the real estate tax statements are to be mailed to the followingnamed person at
<br />the following address:
