<br />SPECIAL WARRANTY DEED
<br />Arlene R. Rivera, ("Grantor"), whose address is1308 8rr' Street, Grand Island, Nebraska
<br />68803, for the consideration of One dollar ($1.00) and other good and valuable consideration,
<br />hereby sells and conveys to Associates Financial Services Cotnpany, Inc. ( "Grantee "), whose
<br />address is 300 Decker Drive, suite 300, Irving, 1'cxa; 75062 the following real property located
<br />in the County of Dawson, State of Nebraska, to wit:
<br />The Southerly One Hundred Ten Feet (S I I O') of Lot Three (3),
<br />Block Three (3), in Dickey Second Subdivision, located in the East
<br />Half of the Southeast Quarter (F- 1 /2SEl!4) of Section One (.I
<br />Township Eleven (11) Notch, Range Ten (10), West of the 6
<br />P.M., Grand Island, Hall County, Nebraska
<br />With all its apputietlances and warrants the title against all persons claiming under Grantor, other
<br />than claims for unpaid owner association assessments, i rally.
<br />Grantor agrees that the conveyance of the Property herein shall not at1ect the validity of
<br />the Decd of Trust ( "Deed of Trust ") recorded on May 30, 1 998, Documents No. 98- 105661 of
<br />the Mortgage Records of Hall County, Nebraska, for the benefit of Associates Financial
<br />Services Company of Nebraska, inc. Grantors also agree -that the fee interest of Grauitee hereby
<br />shall not merge with the interest of Grantee under said Deed of Trust but shall remain at all times
<br />separate and distinct from the lien of the Deed of Trust_ The Property shall be subject to the
<br />valid and continuous lien of the Deed of Trust, subject only to written and recorded release
<br />thereof by Grantee.
<br />This deed is an absolute conveyance. The Grantor has sold the land to the Grantee ii,r a
<br />fair and adequate consideration in addition to that above recited beilig Grantee's agreement not
<br />to sue Grantor for amounts due under a Promissory note dated May 30,1998 and full satisfaction
<br />of all obligations referred to in that Agreement to Convey by Deed in Lieu of I-orcelosure of
<br />Deed of Trust of even dare herewith (the —Agreement').
<br />Csrantor declares that this conveyance is freely and fairly made, and that there arc no
<br />agreements, oral or written, other than the above - referenced Agreement and this deed between
<br />Grantor and Grantee with respect to the Property.
