<br />John H. Bergmeyer, a member of the Nebraska State Bar Association, whose address is 800 Lincoln
<br />Square, 121 S. 13th Street, P.O. Box 82028, Lincoln, Nebraska 68501 -2028, Grantor, as trustee under that
<br />certain Deed of Trust described below (the "Trust Deed "), for valuable consideration, hereby grants and
<br />conveys to Marty Brown and Jamie Brown, Husband and Wife, as joint tenants with rights of survivorship,
<br />and not as tenants in common, Grantees, without any covenant or warranty, expressed or implied, all of the
<br />following described real estate (as defined in NEB. REV. STAT. § 76 -201):
<br />Lots 7 and 8, Block 7, Brett and Johnson's Addition, Village of Wood River, Hall County,
<br />Nebraska (the "Property ").
<br />This conveyance is made pursuant to the powers conferred on Grantor under that certain Trust
<br />Deed dated January 16, 1997, executed by Ervin Beck a /k/a Ervin D. Beck, a single person, as Trustor, in
<br />which AmerUs Bank is named Beneficiary, and filed for record on January 22, 1997, as Instrument No. 97-
<br />100466, in the records of the Register of Deeds of Hall County, Nebraska. By executing the Trust Deed,
<br />the Trustor named therein granted and conveyed to the Trustee named therein, on the trust therein
<br />expressed, the Property to secure, among other obligations, payment of a promissory note of even date in
<br />the original principal amount of $27,800.00 and interest thereon in accordance with the terms set forth in
<br />said promissory note. By and through AmerUs Home Equity, Inc., an Iowa corporation, its attorney -in -fact,
<br />COMMERCIAL FEDERAL BANK, a federal savings bank and successor by merger to AmerUs Bank, as
<br />Beneficiary under the Trust Deed, executed that certain Substitution of Trustee, dated May 23, 2000, and
<br />recorded in the records of the Register of Deeds of Hall County, Nebraska on May 25, 2000, as Instrument
<br />No. 0200004260, and thereby named Grantor as the Successor Trustee under the Trust Deed. Grantor
<br />hereby sets forth the following recitals evidencing the compliance with and satisfaction of all requirements
<br />and conditions specified in the Trust Deed and arising under applicable law to authorize the conveyance of
<br />the property contemplated hereunder:
<br />A. The Trustor named in the Trust Deed defaulted on the obligations arising under the Trust
<br />Deed in the particulars set forth in the Notice of Default described below, and such default
<br />continued until the time of the sale of the Property.
<br />B. The Successor Trustee named above executed that certain Notice of Default dated May 24,
<br />2000 and filed for record in the records of the Register of Deeds of Hall County, Nebraska
<br />on May 25, 2000, as Instrument No. 0200004261. Said Notice of Default was executed and
