WHEREAS, Grantee desires to obtain and Grantors are willing to grant an access <br />easement pursuant to the terms and conditions set forth herein upon the following <br />described property: <br />A tract of land comprising a part East Half of the Northeast Quarter (E1/2 NE' /4) of <br />Section Twelve (12), Township Ten (10) North, Range Eleven (11) West of the 6 <br />P.M., Hall County, Nebraska, and more particularly described as follows: <br />Beginning at the southwest comer of the East Half of Northeast Quarter <br />(E1/2 NE') of said Section Twelve (12); thence N00 °00'00 "E, along and <br />upon the west line of the East Half of Northeast Quarter (E1/2 NE%) of said <br />Section Twelve (12), a distance of Seventeen (17.00) feet; thence <br />S89 °46'35 "E, parallel with and Seventeen (17.00) feet north of (measured <br />perpendicular to) the south line of the East Half of the Northeast Quarter <br />(E1/2 NE'/4) of said Section Twelve (12), a distance of Eight Hundred <br />Seventy One and Forty Three Hundredths (871.43) feet; thence <br />S05 °14'33 "W, a distance of Seventeen and Seven Hundredths (17.07) feet <br />to a point on the south line of the East Half of the Northeast Quarter (E1/2 <br />NE') of said Section Twelve (12); thence N89 °46'35 "W, along and upon <br />the south line of the East Half of the Northeast Quarter (E' /2 NE %) of said <br />Section Twelve (12), a distance of Eight Hundred Sixty Nine and Eighty <br />Seven Hundredths (869.87) feet to the point of beginning and, containing <br />0.340 acres, more or less, of which, 0.013 acres, more or less, is presently <br />occupied by public road right of way; ( "Easement Property "). <br />201804903 <br />NOW, THEREFORE, in consideration of the mutual covenants and agreements of <br />the parties, it is agreed as follows: <br />1. Grantors hereby grant and convey unto Grantee a perpetual easement for <br />access purposes upon the Easement Property. <br />2. "Access purposes" as used in this Easement Agreement means the right to <br />the nonexclusive use of the Easement Property as a means of ingress and egress to and <br />from Grantee's Property by Grantee, his successors in interest, agents, tenants and <br />assigns. <br />3. Grantors shall maintain the Easement Property for access purposes in good <br />repair. Neither Grantors nor Grantee will obstruct access to the easement granted herein. <br />4. Subject to the terms set forth herein, this Easement shall run with the land <br />and shall be binding upon the parties, their successors in interest and assigns. <br />5. This Easement Agreement constitutes the entire agreement of the parties. <br />Any modification of this Easement Agreement shall be binding only if evidenced in <br />writing and signed by all record owners of Grantors' Property and Grantee's Property. <br />
