Description of Leased Premises: <br />LEASE AGREEMENT <br />CD <br />*fade as x0 July 1, 2018 <br />of <br />THIS AGREEMENT entered into between KUESTER LAKE, INC., LESSOR, and Brent L. <br />Johnson and Diane E. Johnson, Husband and Wife, as Joint Tenants and not as tenants in common, <br />LESSEES. <br />A tract of land in the East Half of the Southwest Quarter (E1 /2SW1 /4) of Section <br />Thirteen (13), Township Eleven (11) North, Range Nine (9) West of the 6th <br />P.M., Hall County, Nebraska, being more particularly described as follows: <br />With reference to the Northeast corner of said E1 /2, SW1 /4, thence running on an <br />assumed bearing of N 90° 00' 00" W a distance of 69.30 feet; thence Southerly <br />bearing S 04° 58' 30" E a distance of 418.60 feet to the Actual Point of <br />Beginning; thence running S 13° 49' 17" E a distance of 88.40 feet; thence <br />running S 77° 42' 01" W a distance of 88.83 feet; thence running N 16° 06' 13" <br />W a distance of 75.15 feet; thence running N 69° 22' 34" E a distance of 92.45 <br />feet to the Actual Point of Beginning, also being referred to as Lot Fourteen (14) <br />and the N1 /2 of Lot Fifteen (15), having a lake frontage of 75 feet, and situated <br />on the East side of the East portion of Kuester Lake, and being a part of the E 1/2 <br />SW 1/4, Section Thirteen (13), Township Eleven (11) North, Range Nine (9) <br />West of the 6th, P.M., Hall County, Nebraska. <br />(a) Lessees have complied with all terms of this Lease. <br />(b) Lessees transfer to the new owner all interest and ownership of the Lessees <br />in the common stock of Kuester Lake, Inc. <br />(c) The new Lessees agree, in writing, to abide by the terms of the Lease so <br />assigned, any new Lease of these premises, and to abide by the Agreement <br />entered into by this Lessees' predecessors in title with Kuester Lake, Inc. on <br />or about October 1, 1983, the terms of which are incorporated herein by <br />reference. <br />(d) The new Lessees shall be entitled to a new Lease for a 35 -year term. The <br />term may be longer if consented to by the Lessor. <br />(e) Any subleasing must have the Lessor's approval. <br />(f) The Lessees have the absolute right to conditionally assign this Lease to <br />any mortgagee for the purpose of furnishing such mortgagee additional <br />security. <br />r: fit <br />r') cra <br />CJ'1 <br />CO cry <br />Such lots are shown on the plat in the possession of the Lessor. <br />2. Term of Lease: Thirty-five (35) years, commencing July 1, 2018, and terminating June 30, 2053. <br />3. Option to Extend Term: Lessees have the option to extend the term of this Lease for an <br />additional 35 years by giving Lessor notice thereof, in writing, by January 2, 2053. <br />4. Right to Assignment of Lease: Lessees have the right to assign this Lease provided: <br />5. Rent.
