STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth the <br />terms and conditions, under which the Licensee may construct, maintain, repair, and utilize the following <br />described improvement which will infringe upon City property: <br />Installation, maintenance, and repair of three (3) culverts and two (2) french drain systems into <br />the City's open ditch system, per attached Exhibit "A" (consisting of seven (7) pages), dated <br />2018/4/17. <br />2. DESCRIPTION OF LICENSEE'S REAL ESTATE. The Licensee owns the following <br />described real estate adjacent to the Licensor's real estate to which this License Agreement shall apply: <br />LOT ONE (1), PRIMROSE SUBDIVISION, IN THE CITY OF GRAND ISLAND, HALL <br />COUNTY, NEBRASKA. <br />ALSO DESCRIBED IN SURVEY BY ROCKWELL AND ASSOC. ENGINEERING & <br />SURVEYING, DATED APRIL 28, 2011 AND LAST REVISED UNDER PROJECT NO. (PRC -2) <br />AS FOLLOWS: <br />BEGINNING AT THE SOUTHWEST CORNER OF SAID LOT ONE (1); THENCE RUNNING <br />NORTHERLY ON THE WEST LINE OF SAID LOT ONE (1) AND THE EASTERLY RIGHT OF <br />WAY LINE OF NORTH ROAD, ON AN ASSUMED BEARING OF N00 "W, A DISTANCE <br />OF SIX HUNDRED SEVENTEEN AND ELEVEN HUNDREDTHS (617.11) FEET, TO THE <br />NORTHWEST CORNER OF SAID LOT ONE (1); THENCE RUNNING SOUTH 89°51'02 "E, <br />ON THE NORTH LINE OF SAID LOT ONE (1), A DISTANCE OF THREE HUNDRED SIXTY <br />AND FIVE HUNDREDTHS (360.5) FEET, TO THE NORTHEAST CORNER OF SAID LOT <br />ONE (1); THENCE RUNNING S00 "E, ON THE EAST LINE OF SAID LOT ONE (1), A <br />DISTANCE OF SIX HUNDRED SIXTEEN AND NINETY FIVE HUNDREDTHS (616.95) FEET, <br />TO THE SOUTHEAST CORNER OF SAID LOT ONE (1), AND TO A POINT ON THE <br />NORTHERLY RIGHT OF WAY LINE OF CAPITAL AVENUE; THENCE RUNNING <br />N89 ° 52'37 "W, ON THE SOUTH LINE OF SAID LOT ONE (1) AND THE NORTHERLY RIGHT <br />OF WAY LINE OF CAPITAL AVENUE, A DISTANCE OF THREE HUNDRED SIXTY AND <br />TWENTY FOUR HUNDREDTHS (360.24) FEET, TO THE POINT OF BEGINNING. <br />3.
