STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth the terms and conditions under which the Licensee may construct, maintain, repair, and utilize the following described improvement which will infringe upon real estate owned by the Licensor: To access the City's public right -of -way for installation of Qwest Corporation dba CenturyLink QC fiber cable on Roberts Street for service to 236 West Roberts Street, per the attached exhibit 2. DESCRIPTION OF LICENSEE'S REAL ESTATE. The Licensee has requested such cable be installed to service the described real estate subject to the Licensor's public right -of -way to which this License Agreement shall apply: A tract of land comprising a part of the W% of the SW' of Section 4, in the Township 11 North, Range 9, West of the 6 P.M. in Hall County, Nebraska, more particularly described as follows: Beginning at the intersection of the East right -of -way line of the Burlington Northern Railroad Spur with the northerly line of Rain's First Addition (also being the northerly line of Roberts Street); thence northerly along said railroad right - of - way line, a distance of 109 feet; thence easterly parallel to the northerly line of said Rain's First Addition, a distance of 238.7 feet; thence southerly parallel to said railroad right -of -way line, a distance of 109 feet, to the northerly line of said Rain's First Addition; thence westerly along the northerly line of said Rain's First Addition, a distance of 238.7 feet to the place of beginning and containing 0.597 acres, more or less. 3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that the Licensee may construct, maintain, repair and utilize the above described improvement at the Licensee's sole risk. The Licensee hereby waives any claim for damages against the Licensor, its officers, employee, agents and independent contractors for any damage or injury that may result to said improvement.
