STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth the terms <br />and conditions under which the Licensee may construct, maintain, repair, and utilize the following <br />described improvement which will infringe upon real estate owned by the Licensor: <br />To access the City's public right -of -way for installation of Qwest Corporation dba CenturyLink <br />QC fiber cable on Roberts Street for service to 236 West Roberts Street, per the attached exhibit <br />2. DESCRIPTION OF LICENSEE'S REAL ESTATE. The Licensee has requested such cable be <br />installed to service the described real estate subject to the Licensor's public right -of -way to which this <br />License Agreement shall apply: <br />A tract of land comprising a part of the W% of the SW' of Section 4, in the Township 11 North, Range 9, <br />West of the 6 P.M. in Hall County, Nebraska, more particularly described as follows: <br />Beginning at the intersection of the East right -of -way line of the Burlington Northern Railroad Spur with <br />the northerly line of Rain's First Addition (also being the northerly line of Roberts Street); thence northerly <br />along said railroad right - of - way line, a distance of 109 feet; thence easterly parallel to the northerly line of <br />said Rain's First Addition, a distance of 238.7 feet; thence southerly parallel to said railroad right -of -way <br />line, a distance of 109 feet, to the northerly line of said Rain's First Addition; thence westerly along the <br />northerly line of said Rain's First Addition, a distance of 238.7 feet to the place of beginning and <br />containing 0.597 acres, more or less. <br />3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that the Licensee may <br />construct, maintain, repair and utilize the above described improvement at the Licensee's sole risk. The <br />Licensee hereby waives any claim for damages against the Licensor, its officers, employee, agents and <br />independent contractors for any damage or injury that may result to said improvement.
