Section 12. "Member" shall mean an Owner of a Lot in the Properties. <br />241 804258 <br />Section 13. "Nottingham Estates Owners Association Rules and Regulations" shall <br />mean the rules and regulations adopted by the Board pursuant to Articles II and III. <br />Section 14. "Owner" shall mean and refer to the record owner, whether one or more <br />persons or entities, of a fee simple title to any Lot which is a part of the Properties, excluding <br />those having such interest merely as security for the performance of an obligation, or the <br />purchaser under a recorded contract for the sale and purchase of a Lot under which the seller <br />retains title solely as security for the performance of the purchaser's obligations under the <br />contract. <br />Section 15. "Properties" shall mean and refer to that certain real estate described <br />above which is subject to this Declaration. <br />ARTICLE II <br />PROPERTY RIGHTS <br />Section 1. Owner's Easements of Enjoyment. Every Owner shall have and there is <br />hereby granted to all Owners a right and easement of enjoyment in and to the Common Area <br />located as above described within the Properties which easement shall be appurtenant to and <br />shall pass with the title to every Lot, subject to the right of the Association to suspend the voting <br />rights and right to use of the recreational facilities by an Owner for any period during which any <br />Assessment against this Lot remains unpaid. The Association shall have the right to dedicate or <br />transfer any or all parts of the Common Area to any public agency, authority or utility for such <br />purposes and subject to such conditions as may be agreed to by the members; provided that no <br />such dedication shall be effective unless approved by two - thirds (2/3) of the Members of the <br />Association. <br />Section 2. Delegation of Use. Any Owner may delegate his right of enjoyment to the <br />Common Area and facilities to the members of his family, guests or tenants; provided, however, <br />that said Owner shall be responsible to the Association for the conduct upon and use by said <br />family, guests or tenants of the Common Area. <br />Section 3. Parking Spaces. Ownership of each Lot shall entitle the owner or owners <br />thereof to the use of not more than two (2) automobile parking spaces, which shall be as near and <br />convenient to said Lot as reasonably possible, together with the right of ingress and egress in and <br />upon said parking area. The Board may assign parking spaces in its discretion. <br />ARTICLE III <br />MEMBERSHIP AND VOTING RIGHTS <br />Section 1. Every Owner of a Lot within the Properties shall be a Member of the <br />Association. Membership shall be appurtenant to and may not be separated from ownership of <br />any Lot. <br />4 <br />
