CxT <br />r :73 <br />r <br />Cr) <br />W „ya x,;7 <br />GJ Cn <br />�d3 (r) <br />LICENSE AGREEMENT <br />This License Agreement is made by and between the CITY OF GRAND ISLAND, <br />NEBRASKA, a municipal Corporation, herein referred to as the "Licensor” and GSI SENGINEERING, <br />LLC, hereinafter referred to as the "Licensee." <br />1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth <br />the terms and conditions under which the Licensee may construct, maintain, repair, and utilize the <br />following described improvement which will infringe upon real estate owned by the Licensor: <br />Licensee will install up to two (2) monitoring wells at property in the public right - <br />of -way of Tilden Street, to collect soil and groundwater samples during the <br />installation of such wells. After the borings have been advanced to target depth, <br />permanent monitoring wells will be constructed of 2 -inch diameter, schedule 40 <br />PVC, with a 10 -foot section of 0.010 -inch machine - slotted screen. Such wells <br />shall be locked to prevent tampering, with an 8 -inch diameter steel manhole <br />placed flush over the wells, so as not to interfere with City responsibilities in <br />maintenance of the public right -of -way. The groundwater monitoring wells will be <br />installed for the purpose of environmental characterization. <br />2. DESCRIPTION OF REAL ESTATE. The Licensee has requested such use of public <br />right -of -way to conduct an environmental investigation adjacent to the described real estate to which <br />this License Agreement shall apply: <br />Lots One (1), Two (2) and Three (3), Block Fifteen (15), Baker's Addition to the <br />City of Grand Island, Hall County, Nebraska, EXCEPTING a tract more <br />particularly described in Special Warranty Deed recorded as Document No. <br />200800948 to accommodate the work as described under Section 1 of this <br />License Agreement. <br />3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that the Licensee may <br />construct, maintain, repair and utilize the above - described improvement at the Licensee's sole risk. <br />The Licensee hereby waives any claim for damages against the Licensor, its officers, employees, <br />agents and independent contractors for any damage or injury that may result to said improvement. If <br />the Licensor, in its sole discretion, determines that any part or all of the improvement must be <br />removed or is damaged by the Licensor, its employees, agents or independent contractors working for <br />the Licensor during the course of their employment or duties with the Licensor, the Licensee agrees to <br />assume and pay all costs relating to the replacement or repair of the improvement.
