MINIIIIIMMENNI <br />T S <br />EASEMENT MODIFICATION AGREEMENT <br />DATED: Aour-c1n 1 C)* h ,20 t 6 . <br />Page 1 of 2 <br />AN EASEMENT AGREEMENT was made and entered into March 22, 2013, by and <br />among, MYRON MANNING and KATHRYN MANNING, husband and wife, herein called <br />"MANNING;" KILA R. STRASBURGER AND BRYAN D. STRASBURGER, AS <br />TRUSTEES OF THE CAROLYN I. HALLER MARITAL TRUST, herein collectively called <br />"HALLER;" LUCILLE A. WOODRING, TRUSTEE, herein called "WOODRING;" and <br />GERALD H. POEHLER AND PATRICIA J. POEHLER, AS COTRUSTEES OF THE <br />GERALD H. POEHLER AND PATRICIA J. POEHLER REVOCABLE TRUST, husband and <br />wife, herein collectively called "POEHLER," and it was field of record in the Hall County, <br />Nebraska, Register of deeds on April 24, 2013, as Instrument No. 201303204. <br />RECITALS . ... <br />FOR AND IN CONSIDERATION of the mutual covenants, benefits, and promises set <br />forth hereinafter, it is agreed among the parties as follows: <br />3. Other Easement Terms Remain. All other terms of the original easement <br />agreement shall remain in full force and effect. <br />1. Amendment of Easement. MANNING is no longer desirous of utilizing the <br />natural gas line constructed under MANNING's property. In light of this fact, MANNING shall <br />allow for POEHLER to cap such natural gas line below the ground surface at the level of the <br />buried line. POEHLER shall bear such cost of capping such line. <br />2. Waiver of Access to Line. MANNING agrees to forgo MANNING'S access to <br />such line; however, MANNING will continue to allow for the natural gas line to pass through his <br />property as stated in the original Easement Agreement. <br />
